MUNICIPAL CHARTERS
Sec. 74—A. Referenda.
Upon a resolution adopted by the board of aldermen
by a vote of not less than three—fourths of the members
constituting said board, or upon a petition bearing the
signatures of ten percent of the registered voters of the
city submitted to the mayor and board of aldermen not
less than sixty days prior to any regular municipal
election, such issue as may be framed by said resolution
or such petition shall be submitted to the voters of the
city at the next regular municipal election in such
manner and form as the board of aldermen may order. The
vote of the majority of registered voters on said issue
shall be determinative thereof, but notwithstanding such
vote, nothing herein shall be construed to prevent the
board of aldermen from reviewing the issue and acting
thereon from time to time as the public welfare may
require if otherwise authorized to act by the provisions
of this charter.
SECTION II: BE IT FURTHER RESOLVED, that the date
of the passage of this Resolution is September 12, 1974,
the amendment to the Charter of the City of Frederick,
hereby enacted shall become effective on November 1,
1974, unless a proper petition for referendum herein
shall be filed as provided by Section 13 of Article 23A
of the Annotated Code of Maryland, provided a complete
and exact copy of this Resolution shall be continuously
posted at City Hall, Frederick, Maryland, until November
1, 1974, and provided further that a fair summary of the
proposed amendment shall be posted in a paper of general
circulation, the News—Post, in the City of Frederick,
once in each of the weeks of September 16, 1974,
September 23, 1974, September 30, 1974 and October 7,
1974, and that all sections of the Charter inconsistent
with the provisions of this Resolution be and the same
are hereby repealed to the extent of such inconsistency.
SECTION III: BE IT FURTHER RESOLVED AND ORDAINED
that the Mayor of the City of Frederick shall send
separately by registered mail to the Secretary of the
State of Maryland and the Department of Legislative
Reference a complete text hereof, the date of referendum
election, if any, the number of votes cast for and
against the question containing the charter amendment,
whether in the Legislative Body or in the Referendum and
the effective date of the charter amendment.
