MUNICIPAL CHARTERS

that the Charter of the City of Frederick, as the same
was enacted by the General Assembly of Maryland in
Chapter 539 of the Laws of 1951, be amended by repealing
Article VII, Finance, Section 113, in its entirety, and
placing in lieu thereof, the following:

ARTICLE VII. Finance.

SECTION 113. SALE OF TAX DELINQUENT PROPERTY

A LIST OF ALL PROPERTY ON WHICH THE CITY TAXES HAVE
NOT BEEN PAID AND ARE IN ARREARS AS PROVIDED IN SECTION
111 OF THIS CHARTER SHALL BE TURNED OVER TO THE OFFICIAL
OF FREDERICK COUNTY RESPONSIBLE FOR THE SALE OF TAX
DELINQUENT PROPERTY BY THE CITY TREASURER AS PROVIDED IN
STATE LAW. ALL PROPERTY LISTED THEREON SHALL BE SOLD BY
THIS COUNTY OFFICIAL IN THE MANNER PRESCRIBED BY STATE
LAW. THE TREASURER OF THE CITY OF FREDERICK SHALL ACCEPT
ONLY CASH, CASHIER'S CHECK, CERTIFIED CHECK OR MONEY
ORDER FOR PAYMENT OF DELINQUENT TAXES AFTER THE THIRTY
DAY NOTICE OF SALE HAS BEEN MAILED TO THE PROPERTY OWNERS
WHOSE TAXES ARE IN ARREARS.

SECTION II: BE IT FURTHER RESOLVED that the date of
passage of this Resolution shall be March 21, 1974 and
the amendment to the Charter of the City of Frederick
shall become effective on May 10, 1974, unless a proper
petition for referendum herein shall be filed as provided
by Section 13 of Article 23A of the Annotated Code of
Maryland, and provided a complete and exact copy of this
Resolution shall be continuously posted in City Hall,
Frederick, Maryland, until May 10, 1974, and provided
further that a fair summary of the proposed amendment
shall be published in the News—Post, a paper of general
circulation in the City of Frederick in once in each of
the weeks of March 24, March 31, April 7 and April 14,
1974, and that all sections or parts of sections of the
Charter or ordinances inconsistent with the provisions of
this Resolution be and the same are hereby repealed to
the extent of such inconsistency.

SECTION III: BE IT FURTHER RESOLVED AND ORDAINED
that the Mayor of the City of Frederick shall send
separately by registered mail to the Secretary of the
State of Maryland and the Department of Legislative
Reference the complete text hereof; the date of
referendum election, if any; the number of votes cast
for and against the question containing the Charter
amendment, whether in the legislative body or in a
referendum and the effective date of the Charter
amendment.
