MUNICIPAL CHARTERS
OF THE CITY OF CUMBERLAND (1966 EDITION) BEING ARTICLE 1A
OF THE CODE OF PUBLIC LOCAL LAWS OF MARYLAND, BY
REPEALING AND REENACTING, WITH AMENDMENTS, SUBSECTIONS
(c) AND (k) OF SECTION 36 AND SECTION 38 OF SAID CHARTER,
ALL FOUND UNDER THE TITLE 'CIVIL SERVICE - FIRE AND
POLICE'".
NOW, THEREFORE:
SECTION 1: BE IT RESOLVED BY THE MAYOR AND CITY
COUNCIL OF CUMBERLAND, That subsection (c) of Section 36
of the Charter of the City of Cumberland (1966 Edition),
which reads as follows, be and is hereby repealed:
[The chairman of the commission for each biennial
period shall be the member whose term first expires.
No person, while on the said commission, shall hold
or be a candidate for any office of public trust.
Two of the said members shall constitute a quorum to
transact business. The commissioners must be
citizens of Maryland and residents of the City of
Cumberland for more than three years next preceding
their appointment. Each of the said civil service
commissioners shall receive the sura of fifty
($50.00) dollars per annum for their duties as such;
said sum to be paid semi—annually. The council may
remove any of the said commissioners during their
term of office for cause, four councilmen voting in
favor of such removal, and shall fill any vacancy
that may occur in said commission for the unexpired
term. The city council shall provide a suitable
room in which the said civil service commission may
hold meetings. The city clerk shall act for them
and shall keep a record of all their meetings. The
city shall also supply the said commissioners with
all necessary equipment to properly attend to such
business.]
SECTION 2: AND BE IT FURTHER RESOLVED, That
subsection (c) of Section 36 of the Charter of the City
of Cumberland, be and is hereby reenacted, with
amendments, to read as follows:
"MEMBERS OF THE COMMISSION MUST BE CITIZENS OF
MARYLAND AND RESIDENTS OF THE CITY OF CUMBERLAND FOR MORE
THAN THREE YEARS NEXT PRECEDING THEIR APPOINTMENT. EACH
MEMBER OF THE COMMISSION SHALL RECEIVE SUCH SUM BY WAY OF
COMPENSATION FOR HIS SERVICES AS THE MAYOR AND CITY
COUNCIL MAY FROM TIME TO TIME DESIGNATE. THE CHAIRMAN OF
THE COMMISSION FOR EACH BIENNIAL PERIOD SHALL BE THE
MEMBER WHOSE TERM FIRST EXPIRES. TWO OF SAID MEMBERS
SHALL CONSTITUTE A QUORUM FOR THE PURPOSE OF TRANSACTING
BUSINESS.
