MUNICIPAL CHARTERS

Assembly, subsequently codified as Section 47 of Article
23A of the Annotated Code of Maryland, require the right
to vote by Absentee Ballot in municipal elections; and

WHEREAS, the Mayor and City Council wishes to
implement the mandates of said Chapter 816 and, in
addition, to make provision for the filing and withdrawal
of statements of candidacy as required by Section 10 of
the Charter of the City of Cumberland.

NOW, THEREFORE:

SECTION 1: BE IT RESOLVED BY THE MAYOR AND
CITY COUNCIL OF CUMBERLAND, That the following, to be
designated subsection (h), be and is hereby added to
Section 10 of the Charter of the City of Cumberland:

"(H) THE MAYOR AND CITY COUNCIL SHALL PROVIDE
FOR THE ABSENTEE BALLOT FOR ALL ELECTIONS
AUTHORIZED HEREIN AND SHALL, BY ORDINANCE,
ESTABLISH SUCH PROCEDURES AS MAY BE REQUIRED
TO IMPLEMENT THE SAME."

SECTION 2: AND BE IT FURTHER RESOLVED, That
subsections (a), (b) and (c) of Section 10 of said
Charter be repealed and reenacted, with amendments, to
read as follows:

"(a) Candidates to be voted for at all
general municipal elections at which a
mayor and city councilmen are to be
elected, under the provisions of this
article, shall be nominated by a primary
election, and no other name shall be
placed on the general ballot except
those selected in the manner hereinafter
prescribed. The primary election for
such nomination shall be held on the
second Tuesday preceding the general
election. The judges appointed for the
general municipal election shall be the
judges of the primary election, and the
polls shall be opened and closed at the
same hours and with the same clerks as
are required for the general municipal
election. Any person desiring to become
a candidate for mayor or city council
shall, at least twenty days prior to
said primary election, file IN PERSON
for there shall be filed for him] with
the city clerk a statement of such
candidacy in substantially the following
form:
