THOSE CANDIDATES FOR THE COUNCIL SEAT OR SEATS REMAINING
UNFILLED. SUCH ELECTION SHALL BE HELD NO LATER THAN THE
SECOND TUESDAY OF JUNE AND SHALL IN ALL RESPECTS BY IN
ACCORDANCE WITH THE ELECTION PROVISIONS OF THIS CHARTER.

(P) VACANCIES

IN CASE OF A VACANCY ON THE COUNCIL FOR ANY
REASON, THE COUNCIL SHALL ELECT SOME QUALIFIED PERSON TO
FILL THE VACANCY FOR THE UNEXPIRED TERM. ANY VACANCIES
ON THE COUNCIL SHALL BY THE FAVORABLE VOTES OF A MAJORITY
OF THE REMAINING MEMBERS OF THE COUNCIL. THE RESULTS OF
ANY SUCH VOTE SHALL BE RECORDED IN THE MINUTES OF THE
TOWN.

(Q) REGULATION AND CONTROL

THE COUNCIL HAS THE POWER TO PROVIDE BY
ORDINANCE IN EVERY RESPECT NOT COVERED BY THE PROVISIONS
OF THIS CHARTER FOR THE CONDUCT OF REGISTRATION,
NOMINATION, AND TOWN FLECTIONS AND FOR THE PREVENTION OF
FRAUD IN CONNECTION THEREWITH, AND FOR A RECOUNT OF
BALLOTS IN CASE OF DOUBT OR FRAUD.

(R) FAILURE TO PROCLAIM ELECTION

IN THE EVENT OF THE MAYOR AND COUNCIL FAILING
TO PROCLAIM AN ELECTION AT THE TIME APPOINTED IN
PARAGRAPH (3) OR THE NEGLECT OF THE COUNCIL TO DO ANY
NEEDFUL THING PRESCRIBED THEREIN TO ENSURE THE HOLDING OF
A LEGAL ELECTION TO ELECT THEIR SUCCESSORS, THE CIRCUIT
COURT OF PRINCE GEORGE'S COUNTY, SHALL, UPON THE PETITION
OF FIVE RESIDENTS OF THE TOWN OF BERWYN HEIGHTS ELIGIBLE
TO VOTE IN TOWN ELECTIONS, APPOINT FIVE VOTERS OF THE
TOWN TO CONDUCT AN ELECTION IN THE MANNER IN THIS SECTION
PROVIDED ON AN EARLY DATE TO BE FIXED BY THE COURT.

Code of the State of Maryland (1957 Edition as amended),
the Commissioners of the Town of Berwyn Heights desire to
amend Section 38 (b), and (e), of the Charter of the Town
of Berwyn Heights (February 1, 1964 Edition) in order to
