Replacement Volume), titled "Corporations—Municipal", to
repeal and re—enact Section 24 of the Charter of the City
of Annapolis for the purpose of providing for the
appointment of the police chief, term of office,
qualifications, duties, salary, removal from office, and
all matters relating generally.
SECTION I: BE IT RESOLVED BY THE MAYOR AND ALDERMEN
OF THE CITY OF ANNAPOLIS that Section 24 of the Charter
of the City of Annapolis be and the same is hereby
repealed and re—enacted to read as follows;
Sec. 24. Police ["commissioners] CHIEF.
[There shall be appointed by the mayor and
confirmed by the aldermen of the City of Annapolis a
discrete and capable person who is either a resident
in said city or who resides within five (5) miles of
the boundaries of the city, who shall be styled the
police commissioner of the City of Annapolis. His
term of office shall be concurrent with the term of
office of the city administration by which he is
appointed and confirmed, or until his successor is
duly appointed and qualified.] THERE SHALL BE
APPOINTED BY THE MAYOR AND CONFIRMED BY THE ALDERMEN
A DISCRETE AND CAPABLE PERSON WHO IS A RESIDENT IN
THE CITY OF ANNAPOLIS, WHO SHALL BE STYLED POLICE
CHIEF OF THE CITY OF ANNAPOLIS. THE POLICE CHIEF
SHALL HOLD HIS OFFICE CONTINUOUSLY DURING GOOD
BEHAVIOR, UNLESS INCAPACITATED BY PHYSICAL OR MENTAL
DISABILITY FROM PERFORMING THE DUTIES OF HIS
POSITION. In case of the refusal to act, death,
removal from the city, disqualification or
resignation of said police [commissioner] CHIEF,
such vacancy shall be filled by the mayor and
confirmed by a majority of the [city council]
ALDERMEN at the next session that shall thereafter
happen. He shall be subject to removal by the mayor
and aldermen of the City of Annapolis for official
misconduct or incompetency, provided that he shall
be served with a copy of the charges and
specifications in writing at least five days before a
hearing thereon shall be had. The said
[commissioner] POLICE CHIEF shall not be eligible to
hold an elective office, appointive office or other
employment in any political subdivision nor shall he
hold a political office or be an officer of any
political group while serving as police
[commissioner] CHIEF. [The said mayor and aldermen
of the City of Annapolis shall pay a salary to the
said commissioner of not less than the sum of twelve
hundred ($1,200.00) dollars per annum. There shall
be appropriated each month the sum of not less than
fifty ($50.00) dollars as a contingent fund for the
