House Bill No. 1258 — Montgomery County; Noncertificated
Public School Employees
AN ACT concerning
Montgomery County — Public Education "Agency Shop"
MC 63-75
FOR the purpose of providing that the Montgomery County
Board of Education shall negotiate [[an "agency
shop"]] a nonmember service fee provision with the
[[noncertified]] noncertificated public school
employees organization.

Dear Mr. Speaker:
In accordance with Article II, Section 17 of the
Maryland Constitution, I have today vetoed House Bill
1258.
This bill purports to be an "agency shop" law for
noncertificated public school employees in Montgomery
County. It requires the County Board of Education to
"negotiate and agree to a structure of reasonable service
fees to be charged nonmembers for representation in
negotiation and grievance matters by the organization
which exclusively represents full time noncertificated
public school employees."
Last year, I signed into law Senate Bill 600
(Chapter 630, Acts of 1974) which required the Prince
George's County Board of Education to "negotiate an
organizational security provision, commonly known as
'agency shop' with organizations (note the plural) which
represent full—time noncertificated public school
employees."
House Bill 1258 is alleged to be a counterpart to
Senate Bill 600 of last year. In my judgment, however,
it goes much farther than Senate Bill 600 in both its
adverse effects on noncertificated employees who do not
wish to belong to the exclusive bargaining organization
recognized by the Board and its circumscription of the
Board's discretion.
