3880                                      JOINT RESOLUTIONS

RESOLVED, That the individuals selected be selected
if possible because of prior military background; and be
it further

RESOLVED, That the Military Department be directed
to cooperate with the work of the Committee in every way
possible; and be it further

RESOLVED, That copies of this Resolution be sent to
the Governor.

A House Joint Resolution concerning

National Shellfish Safety Program

FOR the purpose of requesting the Congress of the United
States to prohibit the Department of Health,
Education, and Welfare, Food and Drug Administration
from promulgating or imposing any mandatory rules or
regulations governing the United States shellfish
industry until such time as an independent study is
made for the Congress which would determine factual
microbiological standards to be used for the
protection of shellfish consumers and, at the same
time, provide acceptable standards and regulations
for the nation's shellfish producers, packers, and
handlers.

WHEREAS, The Commissioner of the Food and Drug
Administration has concluded that scientific data are not
available to support present standards for bacteria or
toxic metals (except mercury) in shellfish; and

WHEREAS, The Food and Drug Administration has
proposed rules and regulations which would preempt state
control over every aspect of the seafood industry,
including water quality, licensing and inspection of
vessels, and establishments used in harvesting,
recreational catches, processing, packaging, marketing,
shipping; and

WHEREAS, It is necessary in the interest of both our
public health and of our seafood industry to develop
accurate information for realistic microbiological
