A Senate Joint Resolution concerning
Pensions — Study of Judicial System
FOR the purpose of requesting the Governor of Maryland to
appoint a commission to make a study of the Judicial
Pension System and requesting the Commission to
submit its report in 1976.
WHEREAS, The provisions of the pension system now
provided for members of the judiciary in Maryland have
been reviewed and revised for various reasons in recent
years; and
WHEREAS, Despite these amendments of the Judicial
pension laws, the judicial system still is in need of
further review; and
WHEREAS, Some of the problems in the judicial system
that need correction are the following:
1. Development of an actuarially sound basis for
the system. What started as a noncontributory system in
its early form was revised in 1969 to place newly
appointed judges on a contributory basis and has now been
further amended to bring as many judges as possible under
the contributory system. This change in form of the
system now warrants consideration of its actuarial base
and further change to assure the financial soundness of
the system.
2. Consideration of the effect of growth in the
number of judges entering the system. The size of the
State's judiciary has steadily grown with the creation
and then expansion of the Court of Special Appeals, the
expansion of judgeships at the Circuit Court level, and
