"PERSON" INCLUDES AN INDIVIDUAL, CORPORATION,
BUSINESS TRUST, ESTATE, TRUST, PARTNERSHIP, ASSOCIATION,
TWO OR MORE PERSONS HAVING A JOINT OR COMMON INTEREST, OR
ANY OTHER LEGAL OR COMMERCIAL ENTITY.
REVISOR'S NOTE: This subsection is new language
setting forth a broad, standardized definition
of the word "person" as used in this article.
It is a synthesis of the U.C.C. definitions of
"person" and "organization" contained in
§1-201 (28) and (30) of this article, except
that the reference to "government or
governmental subdivision or agency" is not
included. This definition, which replaces
that presently appearing as Art. 27, §355A(a),
is in no way intended to change the existing
law, merely to clarify it.
11-602. SUBTITLE NOT TO APPLY TO CERTAIN PERSONS AND
CONTAINERS.
THIS SUBTITLE DOES NOT APPLY TO ANY CONTAINER WHICH
HAS A TOTAL CAPACITY OF FIVE GALLONS OR LESS.

11-603. UNLAWFUL USE OF CONTAINERS.
UNLESS HE IS AUTHORIZED BY THE OWNER IN WRITING, A
PERSON OTHER THAN THE OWNER OF A CONTAINER MAY NOT:
(1) FILL OR REFILL A MARKED CONTAINER WITH
LIQUEFIED PETROLEUM GAS OR ANY OTHER GAS OR COMPOUND;
(2) BUY, SELL, OFFER FOR SALE, GIVE, TAKE, LOAN,
DELIVER, PERMIT TO BE DELIVERED, OR OTHERWISE USE,
DISPOSE OF, OR TRAFFIC IN A MASKED CONTAINER; OR
(3) DEFACE, ERASE, OBLITERATE, COVER UP, OR
OTHERWISE REMOVE OR CONCEAL ANY MARK ON A CONTAINER.

Item (1) of this section has been revised to
clarify its applicability to a "marked
container," rather than to any container,
whether marked or not. This reading is
apparent from the general structure of this
subtitle, as well as the more specific
references in present §§ 355C and 355D - now
