Title 8. Water and Water Resources

SUBTITLE 16. CHESAPEAKE BAY AND TRIBUTARIES

8-1601. LEGISLATIVE DECLARATION.

(A) THE GENERAL ASSEMBLY DECLARES THAT THE
CHESAPEAKE BAY AND ITS TRIBUTARIES (WITHIN THE TIDEWATER
PORTIONS THEREOF) ARE A GREAT NATURAL ASSET AND RESOURCE
TO THE STATE AND ITS COUNTIES, PORTIONS OF THESE AREAS
ARE THREATENED WITH INUNDATION BY THE UNCONFINED DUMPING
OF VAST QUANTITIES OF [MUCK, WASTE, AND POLLUTED SOIL]]
SPOIL FROM DREDGING OPERATIONS WITHIN [[THE PATAPSCO
RIVER AND]] BALTIMORE HARBOR. THIS INUNDATION AND
UNCONFINED DUMPING WILL POLLUTE AND DESPOIL VALUABLE
PORTIONS OF THE BOTTOMLAND IN THE CHESAPEAKE BAY AND ITS
TIDEWATER TRIBUTARIES AND BE GROSSLY HARMFUL TO FISH AND
[[MINERAL]] MARINE LIFE IN THESE AND ADJACENT WATERS, TO
USE FOR RECREATION, AND TO THE ECONOMIC AND SOCIAL LIFE
OF THE PEOPLE OF THIS STATE.

(B) (I) BALTIMORE HARBOR; CONSISTS OF THE TIDAL

PORTIONS OF PATAPSCO RIVER AND ITS TRIBUTARIES LYING

WESTWARD OF A LINE EXTENDING FROM ROCK POINT IN ANNE
ARUNDEL COUNTY TO NORTH POINT IN BALTIMORE COUNTY.

(II) SPOIL SHALL MEAN; EARTH, ROCK, SOIL,
WASTE MATTER. BUCK. OR OTHER MATERIAL EXCAVATED OR
DREDGED PROM BALTIMORE HARBOR.

8-1602. DUMPING PROHIBITED.

IT IS UNLAWFUL FOR ANY PERSON, FIRM, OR CORPORATION,
TO DUMP, DEPOSIT, OR SCATTER [[SOIL, WASTE MATTER, MUCK,
OR OTHER MATERIAL DREDGED OR OTHERWISE RECLAIMED FROM THE
WATER OR BOTTOMLAND OF THAT PORTION OF THE PATAPSCO RIVER
COMPRISING]] IN AN UNCONFINED MANNER SPOIL FROM BALTIMORE
HARBOR, INTO OR ONTO ANY PORTION OF THE WATER OR
BOTTOMLAND OF THE CHESAPEAKE BAY OR OF THE TIDEWATER
PORTIONS OF ANY OF ITS TRIBUTARIES OUTSIDE OF BALTIMORE
HARBOR PROVIDED THAT THE SPOIL MAY BE REDEPOSITED IN
CONTAINED AREAS APPROVED BY THE DEPARTMENT OF NATURAL
RESOURCES.

8-1603. INJUNCTIVE RELIEF.

THE ATTORNEY GENERAL OF MARYLAND OR THE STATE'S
ATTORNEY OF ANY COUNTY OF THIS STATE WHICH BORDERS UPON A
