BY repealing and re—enacting, with amendments,

Article 41 — Governor — Executive and Administrative

Departments
Section 206A and 206B
Annotated Code of Maryland
(1971 Replacement Volume and 1974 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 568N of Article 43 - Health, of
the Annotated Code of Maryland (1971 Replacement Volume
and 1974 Supplement) be and it is hereby repealed and
re—enacted, with amendments, to read as follows:

Article 43 - Health

568N.

(A)    Any persons aggrieved by a final determination
of the Commission under the provisions of this subtitle
may appeal therefrom as provided by §§ [206A, 206B,] 255
and 256 of Article 41.

(B)    ANY APPEAL FROM A FINAL DETERMINATION OF THE
COMMISSION PURSUANT TO THIS SECTION SHALL BE TAKEN IN THE
NAME OF THE PERSON AGGRIEVED AS APPELLANT, AGAINST THE
COMMISSION AS APPELLEE, AND THE COMMISSION SHALL BE A
NECESSARY PARTY TO THE APPEAL AT ALL LEVELS OF THE
APPEAL, WHETHER ADMINISTRATIVE OR JUDICIAL. THE
COMMISSION MAY APPEAL AN ADMINISTRATIVE OR JUDICIAL
DECISION AFFECTING ANY OF ITS FINAL DETERMINATIONS TO A
HIGHER LEVEL FOR FURTHER REVIEW. ANY AGGRIEVED PARTY OR
INTERESTED PERSON MAY INTERVENE OR PARTICIPATE IN AN
APPEAL, AT ANY LEVEL THEREOF, UPON GRANT OF LEAVE BY THE
APPROPRIATE AGENCY OR COURT.

SECTION 2. AND BE IT FURTHER ENACTED, That Sections
206A and 206B of Article 41 — Governor — Executive and
Administrative Departments, of the Annotated Code of
Maryland (1971 Replacement Volume and 1974 Supplement) be
and they are hereby repealed and re—enacted, with
amendments, to read as follows:
