SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Sections 29-2(f) , 29-4(a), (b-1), (b-2) ,
(b-3) and 29-5(d) of Article 33 - Election Code, of the
Annotated Code of Maryland (1971 Replacement Volume and
1974 Supplement) be and they are hereby repealed and
re-enacted, with amendments, to read as follows:
Article 33 — Election Code
29-2.
(f) "Gift" [includes any gift, reward, honorarium,
or testimonial, whether or not it relates to the
performance of official duties] MEANS A PAYMENT,
HONORARIUM, SUBSCRIPTION, ADVANCE, FORBEARANCE,
[[RENDERING]] GIVING OR DEPOSIT OF HONEY, SERVICES OR
ANYTHING OF VALUE, UNLESS CONSIDERATION OF EQUAL OR
GREATER VALUE IS RECEIVED. "GIFT" DOES NOT INCLUDE A
POLITICAL CONTRIBUTION OTHERWISE REPORTED IS REQUIRED BY
LAW; A COMMERCIALLY REASONABLE LOAN MADE IN THE ORDINARY
COURSE OF BUSINESS; OR A GIFT RECEIVED FROM A MEMBER OF
THE PERSON'S IMMEDIATE FAMILY OR FROM A RELATIVE WITHIN
THE THIRD DEGREE OF CONSANGUINITY OF THE PERSON OR OF THE
PERSON'S SPOUSE OR FROM THE SPOUSE OF ANY SUCH RELATIVE.
29-4.
(a) Each person holding an office set forth in
section 29—3 above on or after the effective date of this
subtitle shall file UNDER OATH OR AFFIRMATION with the
Secretary of State, on or before the 15th day of April of
each year during that persons term in office, the
statement required by this subtitle, for the calendar
year immediately preceding each such year in office.
However, any statement to be filed pursuant to the
foregoing on or before April 15, and any statement filed
by a candidate for nomination for, or election to, an
elective office to be filled in 1974, pursuant to
subsections (b-1) and (b-2) below, shall only be for that
portion of the calendar year 1973 which begins with the
effective date of this subtitle and extends through
December 31, 1973.
(b—1) Except for a person who has filed a statement
pursuant to subsection (a) above for the same year or
portion of the same year for which a statement otherwise
would be required to be filed by this subsection, each
candidate for nomination for, or election to, an office
set forth in subsections 29—3 (a), (b), (c), (d), (h) [or
(i) ]or (i) [[(I), (N), (O), (P), (Q), OR (R)]] above
shall file UNDER OATH OR AFFIRMATION with the State
Administrative Board of Election Laws[, at or before the
same time] [[OR THE COUNTY BOARD OF ELECTION LAWS]] that
person's certificate of candidacy [[is filed,]] AND the
