AN ACT concerning

Alcoholic Beverages — Beer Franchise Fair Dealing Act

FOR the purpose of providing for a cause of action
against a beer franchisee for damages sustained from
a violation of the Beer Franchise Fair Dealing Act.

BY repealing and re-enacting, with amendments,

Article 2B — Alcoholic Beverages

Section 203G

Annotated Code of Maryland

(1968 Replacement Volume and 1974 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 203G of Article 2B - Alcoholic
Beverages, of the Annotated Code of Maryland (1968
Replacement Volume and 1974 Supplement) be and it is
hereby repealed and re—enacted, with amendments, to read
as follows:

Article 2B — Alcoholic Beverages

203G.

Any beer distributor or franchisee may bring an
action against a beer manufacturer [or], franchisor, OR
FRANCHISEE for violation of this subtitle in any court of
general jurisdiction in the State of Maryland to recover
damages sustained by reason of any violation of this
subtitle and, where appropriate, shall be entitled to
injunctive relief. The beer distributor or franchisee,
if successful, shall also be entitled to the costs of the
action including but not limited to reasonable attorney's
fees.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1975.
