Article 59A — Mental Retardation

Annotated Code of Maryland

(1972 Replacement Volume and 1974 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 4 of Article 59A - Mental
Retardation, of the Annotated Code of Maryland (1972
Replacement Volume and 1974 Supplement) be and it is
hereby repealed and re—enacted, with amendments, to read
as follows:

Article 59A — Mental Retardation

(a)      Specific jurisdiction with regard to
administration and supervision of the care, custody and
treatment of the mentally retarded shall be delegated to
the Mental Retardation Administration which shall be a
part of the Department of Health and Mental Hygiene of
the State.

(b)    The provisions of [subsection (a) of] this
[section] ARTICLE shall not prevent mentally retarded
persons AND NONRETARDED DEVELOPMENTALLY DISABLED PERSONS
from being eligible for foster care, ASSISTANCE WITH
RESPECT TO PLACEMENT IN FOSTER CARE, AND ANY OTHER
SERVICES THAT MAY BE PROVIDED BY[[,]] [nor shall they
prevent] the Social Services Administration or any local
department of social services [from providing assistance
with respect to the placement of mentally retarded
persons in foster care].

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1975.
