The Public Local Laws of Baltimore City

Section 26—1, to be under the new subtitle "Business

Displacement Benefits"
Article 4 - Public Local Laws of Maryland
(1969 Edition, as amended)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 26—1 to be under the new
subtitle "Business Displacement Benefits" be and it is
hereby added to the Code of Public Local Laws of
Baltimore City being Article 4 of the Code of Public
Local Laws of Maryland (1969 Edition, as amended) to read
as follows:

Article 4 - Baltimore City

BUSINESS DISPLACEMENT BENEFITS
26-1.

IN ADDITION TO ANY BENEFITS THAT MAY BE PROVIDED BY
ANY STATE, FEDERAL OR LOCAL LAW, A PERSON WHO IS
DISPLACED FROM HIS PLACE OF BUSINESS AS THE RESULT OF THE
ACQUISITION OF REAL PROPERTY BY THE CITY OF BALTIMORE
AFTER THE EFFECTIVE PATE OF THIS ACT SHALL BE ENTITLED TO
THE BENEFITS ENUMERATED IN THIS SECTION PROVIDED SUCH
DISPLACEE RELOCATES THE ENTIRETY OF HIS DISPLACED
BUSINESS OPERATION WITHIN BALTIMORE CITY WITHIN ONE YEAR
FROM THE DATE OF ACQUISITION OF THE PROPERTY FROM WHICH
HE IS DISPLACED.

A.      AS USED IN THIS SECTION, THE FOLLOWING
DEFINITIONS SHALL APPLY:

BASE RENTAL - AN AMOUNT NOT TO EXCEED ACTUAL RENT
PAID, ATTRIBUTABLE TO SHELTER RENT AND REAL ESTATE TAXES.

CALCULATED BASE RENTAL - AN AMOUNT CALCULATED BY THE
DEPARTMENT EQUAL TO THE SHELTER RENT AND REAL ESTATE
TAXES FOR A PROPERTY OWNED OR PURCHASED BY A DISPLACEE OR
AVAILABLE FOR PURCHASE ON THE MARKET.

DEPARTMENT - DEPARTMENT OF HOUSING AND COMMUNITY
DEVELOPMENT OF BALTIMORE CITY, OR SUCH OTHER AGENCY OF
THE CITY OF BALTIMORE AS MAY HEREAFTER BE DESIGNATED TO
ADMINISTER THE PROVISIONS OF THIS SECTION.

SHELTER RENT - THAT PORTION OF THE RENTAL VALUE OR
ACTUAL RENTAL AMOUNT OF A PROPERTY APPORTIONED BY THE
DEPARTMENT TO ACTUAL USE OF THE PREMISES, EXCLUDING ALL
OTHER SERVICES, TAXES, OR CHARGES WHATSOEVER.

B.    ELIGIBLE DISPLACEES SHALL BE ENTITLED TO AN
