(D) PERSON.
"PERSON" INCLUDES AN INDIVIDUAL, CORPORATION,
BUSINESS TRUST, ESTATE, TRUST, PARTNERSHIP, ASSOCIATION,
TWO OR MORE PERSONS HAVING A JOINT OR COMMON INTEREST, OR
ANY OTHER LEGAL OR COMMERCIAL ENTITY.
REVISOR'S NOTE: This subsection is new language
setting forth a broad, standardised definition
of the word "person" as used in this article.
It is a synthesis of the U.C.C. definitions of
"person" and "organization" contained in
§1-201 (28) and (30) of this article, except
that the reference to "government" and
"governmental subdivision or agency" is not
included. This definition is in no way
intended to change the existing law; merely to
clarify it.
(E) REPLACEMENT COST.
"REPLACEMENT COST" MEANS THE COST PER UNIT FOR WHICH
THE MERCHANDISE SOLD OR OFFERED FOR SALE COULD HAVE BEEN
BOUGHT BY THE WHOLESALER OR RETAILER AT ANY TIME WITHIN
30 DAYS BEFORE THE DATE OF SALE OR THE DATE ON WHICH IT
IS OFFERED FOR SALE BY HIM IF BOUGHT IN THE SAME QUANTITY
AS HIS LAST PURCHASE OF THE MERCHANDISE.
REVISOR'S NOTE: This subsection presently appears as
Art. 83, §112(c).
The defined terns "wholesaler or retailer" are
substituted for the undefined "seller" to
conform to the general usage of this subtitle.

(F) RETAILER.
(1) "RETAILER" MEANS A PERSON ENGAGED IN THE
BUSINESS OF MAKING RETAIL SALES WITHIN THE STATE.
(2) IF THE PERSON IS ENGAGED IN THE BUSINESS
OF MAKING BOTH RETAIL SALES AND WHOLESALE SALES, THE WORD
APPLIES ONLY TO THE RETAIL SALES PORTION OF THE BUSINESS.

The references to "partnership, corporation or
association" are deleted as unnecessary in
