SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 129A(c) of Article 43 - Health, of
the Annotated Code of Maryland (1971 Replacement Volume
and 1974 Supplement) be and it is hereby repealed and
re—enacted, with amendments, to read as follows:

Article 43 - Health

129A.

(c) A violation of the provisions of this section
[shall constitute] IS a misdemeanor and upon conviction
[thereof may be punished by] IS SUBJECT TO a fine [of not
more than five thousand dollars] NOT EXCEEDING $5,000, OR
IMPRISONMENT NOT EXCEEDING ONE YEAR, OR BOTH.

SECTION 2. AND BE IT FURTHER ENACTED, That new
Section 129A(e) be and it is hereby added to Article 43 —
Health, of the Annotated Code of Maryland (1971
Replacement Volume and 1974 Supplement) to read as
follows:

Article 43 - Health

129A.

(E) (1) NO PERSON, FIRM, PARTNERSHIP,
ASSOCIATION OR CORPORATION, OR ITS AGENT OR EMPLOYEE MAY
OPERATE AN ABORTION REFERRAL SERVICE UNLESS THE SERVICE
IS REGISTERED WITH THE STATE DEPARTMENT OF HEALTH. THE
STATE DEPARTMENT OF HEALTH SHALL PROPOSE AND ENACT
REGULATIONS FOR ABORTION REFERRAL SERVICES INCLUDING
MEDICAL STANDARDS[[ , ]] AND GUIDELINES FOR REFERRAL
PROCEDURE AND TRAINING FOR THE STAFF.

(2) [[NO ABORTION REFERRAL SERVICE MAY REFER
ANY USER OF THE SERVICE TO ANY OUT-OF-STATE ABORTION
CLINIC WHICH DOES NOT FOLLOW PROCEDURES CONSIDERED
