LAWS OF MARYLAND

[Ch. 672

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Sections 38B(a) , (b) , (c) , (f) and 211-I(b)
of Article 89B — State Roads, of the Annotated Code of
Maryland (1969 Replacement Volume and 1974 Supplement) be
and they are hereby repealed and re—enacted, with
amendments, to read as follows:

Article 89B - State Roads

38B.

(a)  [Out of the highway user revenues, as defined in
§ 38A (b) of this article which are allocated from the
gasoline and motor vehicle revenue account of the
Transportation Trust Fund, as provided for in § 11 (b) of
Article 94A, to Baltimore City to be used for the
purposes set forth in § 33 of this article, or to the
several counties and municipalities of the State to be
used for the purposes set forth in § 34 of this article,
received by either Baltimore City, or the several
counties and municipalities of the State, there may be
expended reasonable amounts for the establishment and
maintenance of footpaths, bridle paths or horse trails
and bicycle trails whenever a highway, road or street is
being constructed, reconstructed or relocated and highway
user revenues are being used for such construction,
reconstruction or relocation. Highway user revenues may
also be expended to establish and maintain footpaths,
bridle paths or horse trails and bicycle trails along
other highways, roads and streets and in parks and
recreational areas.] ANY COUNTY , BALTIMORE CITY, OR
MUNICIPAL CORPORATION, WHICH RECEIVES HIGHWAY USER
REVENUE UNDER SECTION 33 OR SECTION 34 OF THIS ARTICLE,
MAY EXPEND A REASONABLE PORTION TO ESTABLISH AND MAINTAIN
FOOTPATHS, BRIDLE PATHS OR HORSE TRAILS, AND BICYCLE
TRAILS.

(b)  [In lieu of actually expending or obligating
highway user revenue funds for the purposes permitted by
this section, the] THE State Highway Administration, the
City of Baltimore, and the several counties and
municipalities of the State may credit [such funds]
HIGHWAY USER REVENUES to a financial reserve or special
fund. THESE REVENUES [to] MAY NOT be held for [not] more
than [10] TEN years [and to be] BEFORE THEY ARE expended
[only] for the purposes [required or permitted by] OF
this section.

(c)  Footpaths, bridle paths or horse trails [or]
bicycle trails [shall not] MAY be established under
subsection (a) of this section, [if:] UNLESS:
