Article 88B - State Police
Section 53(1)
Annotated Code of Maryland
(1969 Replacement Volume and 1974 Supplement)
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 53(1) of Article 88B - State
Police, of the Annotated Code of Maryland (1969
Replacement Volume and 1974 Supplement) be and it is
hereby repealed and re—enacted, with amendments, to read
as follows:

53.
(1) (a) Any member may retire upon written
application to the board of trustees setting forth at
what time he desires to be retired, provided that [such]
THE member at the time so specified for his retirement
shall have attained the age of 50 OR SHALL HAVE COMPLETED
25 YEARS OF CREDITABLE SERVICE, and notwithstanding that
during [such] THE period of notification he may have
separated from service[, excepting the], THE physician
of the Department [who] shall have attained the age of 65
at the time specified for his retirement.
(b) The Superintendent of Maryland State
Police [is authorized 1, subject to the approval of the
board of trustees, [to] MAY order any member in service
who [shall have] HAS attained the age of 50 [[OR HAS
COMPLETED 25 YEARS OF CREDITABLE SERVICE]] to retire on
the first day of the next calendar month after which
[such] THE member [shall be] IS notified of the
Superintendent's order [, provided, that said]. HOWEVER,
THE board, before giving its approval as aforesaid, shall
first give at least [10] [[TEN]] THIRTY days notice to
the member concerned and afford him an opportunity to be
heard.
(c) Any member in service who has attained
the age of 60 shall be retired on the first day of the
next calendar month after attaining [such] THAT age,
excepting the physician of the Department who shall be
retired on the first day of the next calendar month after
