licensee resides, unless the Administration and the
licensee agree that the hearing may be held in some other
county or Baltimore City or at the Administration. Upon
the hearing the Administrator or his duly authorized
agent may administer oaths and issue subpoenas for the
attendance of witnesses and the production of relevant
books and papers and may require a reexamination of the
licensee. Upon the hearing the Administration either
shall rescind its order of suspension or, good cause
appearing therefor, may continue, modify, or extend the
suspension of the license or revoke the license.] AND
THE APPLICANT OR LICENSEE MAY REQUEST A HEARING AS
PROVIDED IN SECTION 2-319[[. The Administration shall
notify the licensee of its action within 60 days of the
hearing]] UNLESS IT APPEARS TO THE ADMINISTRATION THAT
THERE IS A LIKELIHOOD OF SUBSTANTIAL AND IMMEDIATE DANGER
AND HARM TO THE LICENSEE OR OTHERS IF HIS LICENSE IS
CONTINUED PENDING A HEARING. IF THE ADMINISTRATION
SUSPENDS A LICENSE DUE TO A DETERMINATION THAT
SUBSTANTIAL AND IMMEDIATE DANGER AND HARM TO THE LICENSEE
AND OTHERS EXISTS, THE ADMINISTRATION, AFTER SUSPENSION
SHALL GRANT THE LICENSEE A HEARING AS PROVIDED IN SECTION
2-319 OF THIS ARTICLE WITHIN 7 DAYS OF A REQUEST FOR A
HEARING AND AN IMMEDIATE DECISION SHALL ISSUE AS TO
WHETHER THE SUSPENSION SHOULD CONTINUE.

(c) If no hearing is requested the [Department]
ADMINISTRATION either shall continue, modify, or extend
the suspension of the license or revoke the license.

6-207.

If a licensee is involved in an accident resulting
in the death of another, or if the [Department]
ADMINISTRATION has good cause to believe that a licensee
is incompetent or otherwise not qualified to be licensed,
the [Department] ADMINISTRATION upon written notice of at
least 7 days to the licensee may require him to submit to
an examination. Upon the conclusion of the examination
the [Department] ADMINISTRATION shall take action as may
be appropriate and may suspend or revoke the license of
the person or permit him to retain the license, or may
issue a license subject to restrictions as permitted
under § 6-113. IF SUSPENSION OR REVOCATION OF THE LICENSE
OF THE PERSON IS CONTEMPLATED, THE ADMINISTRATION SHALL
PROCEED UNDER SECTION 6-206. Refusal or neglect of the
licensee to submit to the examination may be ground for
suspension or revocation of his license. [[A LICENSEE
MAY REQUEST A HEARING UNDER THIS SECTION AS PROVIDED IN
SECTION 2-319.]]
