[Ch. 612

[[SECTION 2. AND BE IT FURTHER ENACTED, That new
Sections 8-101 through 8—411, inclusive, to be under the
new subtitle "Subtitle 1. Wild and Scenic Rivers" be and
they are hereby added to Article — Natural Resources, of
the Annotated Code of Maryland (1974 Volume and 1971
Supplement) to read as follows:

Article — Natural Resources

SUBTITLE 1. WILD AND SCENIC RIVERS.

8-101.

(A)    IN THIS SUBTITLE, THE FOLLOWING TERMS HAVE THE
MEANINGS INDICATED.

(B) "DEVELOPMENT" MEANS ANY STRUCTURE,
APPURTENANCE, OTHER ADDITION, MODIFICATION, OR ALTERATION
CONSTRUCTED, PLACED OR MADE ON OR TO LAND OR WATER, OR
ANY ACTIVITY RESULTING IN THE REGULAR OCCURRENCE OF
UNNATURAL NOISE.

(C)    "FREE FLOWING RIVER" MEANS A RIVER THAT EXISTS
OR FLOWS IN A SUBSTANTIALLY NATURAL CONDITION, WITHOUT
SIGNIFICANT OR CONTROLLING IMPOUNDMENT, DIVERSION,
STRAIGHTENING, RIP-RAPPING OR OTHER MODIFICATIONS AND MAY
INCLUDE RIVERS WITH LOW DAMS, DIVERSION WORKS AND OTHER
MINOR STRUCTURES.

(D)      "RIVER" MEANS A FLOWING BODY OF WATER OR
ESTUARY, OR A STRETCH, SECTION, OR TRIBUTARY OF A BODY OF
WATER OR ESTUARY.

(E)    "SCENIC RIVER" MEANS A FREE FLOWING RIVER
WHOSE RELATED SHORELINES ARE PREDOMINATELY FORESTED,
AGRICULTURAL, GRASSLAND, MARSHLAND, OR SWAMPLAND WITH A
MINIMUM OF DEVELOPMENT FOR AT LEAST TWO MILES OF THE
RIVER LENGTH.

(F) "SHORELINE" MEANS THE NON-SUBMERGED LANDS
ADJACENT TO A RIVER.

(G)      "WILD RIVER" MEANS A FREE FLOWING RIVER WHOSE
RELATED SHORELINES ARE UNDEVELOPED, INACCESSIBLE EXCEPT
BY TRAIL, OR PREDOMINATELY PRIMITIVE IN A NATURAL STATE
FOR AT LEAST FOUR MILES OF THE RIVER LENGTH.

8-102.

CERTAIN RIVERS OF THE STATE AND THEIR SHORELINES
POSSESS EXTRAORDINARY SCENIC, AESTHETIC, RECREATIONAL,
GEOLOGICAL, ECOLOGICAL, HISTORICAL, CULTURAL, WILDERNESS,
OR FISH AND WILDLIFE VALUES. THE POLICY OF THE STATE IS
TO PROTECT AND RETAIN THESE VALUES BY PRESERVING THESE
