and bond provided for in the specifications.

(d)    If any bidder who files a bid bond under the
provisions of this section [shall fail] FAILS to promptly
and properly execute the bond for the completion of the
work provided thereunder, as provided in the
specifications, then [said] THE bid bond shall be in
default and the surety [shall be] IS liable thereon for
the full amount of damage sustained by the [State Roads
Commission] ADMINISTRATION by reason of the failure of
the bidder to promptly and properly execute a bond for
the completion of the work.

(e)    The checks of the unsuccessful bidders shall
be returned to them after opening the bids and awarding
the contract to the successful bidder. [Provided,
however, that the said Commission may itself] THE
ADMINISTRATION MAY do any part or parts of any such work
under such conditions in every respect as it may
prescribe by day labor in all cases wherein the funds
provided for the carrying on or performance of such work
are provided by the government of the United States of
America, or any agency thereof, and the said government,
or any agency thereof, shall require that such work be
performed by day labor employed by [said Commission. And
provided further that nothing] THE ADMINISTRATION.
NOTHING in this section shall be construed to prohibit
the use by the [said Commission] ADMINISTRATION of free
labor supplied by relief or charity agencies or
organizations.

This section [shall] DOES not apply to those
counties or authorized road departments of the several
counties who, by appropriate resolution, passed by the
county commissioners, determine to conduct construction
and improvements on county roads with their own forces,
regardless of the source of funds that are to be used to
pay the cost of such construction or improvements,
provided that the [said] county commissioners shall file
with the [State Roads Commission] ADMINISTRATION, within
six months after the end of each calendar year, or fiscal
year if the [said] county is operating on that basis, a
complete report with respect to each project constructed
during [said] THE calendar year [and/or fiscal year, as
the case may be, which] OR FISCAL YEAR, THE REPORT shall
include a full audit of all accounts of [said] THE county
commissioners relating to each [said] project, and an
engineering statement setting forth separately and in
detail all items of cost incurred.

This section [shall] DOES not apply to those
counties in which the [State Roads Commission]
ADMINISTRATION maintains county roads when [said
Commission shall determine] THE ADMINISTRATION DETERMINES
