LAWS OF MARYLAND

[Ch. 553

THE MASTER APPLICATION FORM SHALL BE DESIGNED TO
FURNISH BASIC INFORMATION CONCERNING A PROJECT WHICH IS
COMMON TO AND NEEDED BY ALL OR MOST OF THE STATE AGENCIES
ISSUING PERMITS. IT SHALL PROVIDE FOR A LISTING OF EACH
STATE AGENCY FROM WHICH A PERMIT IS REQUESTED, AND A
DESCRIPTION OF THE PERMIT REQUESTED. EACH STATE AGENCY
HAVING JURISDICTION TO ISSUE A PERMIT SHALL ASSIST THE
COORDINATOR IN DEVELOPING AN APPENDIX TO THE MASTER
APPLICATION DESIGNED TO SUPPLEMENT THE INFORMATION ON THE
MASTER APPLICATION AND FURNISH THE PARTICULAR INFORMATION
NEEDED BY THE AGENCY WITH RESPECT TO THE PERMIT IT
ISSUES. TO THE EXTENT POSSIBLE, THE BASIC FORMAT OF THE
APPENDICES SHALL BE SIMILAR. IF A MASTER APPLICATION
FORM IS DEVELOPED, IT, AND THE NECESSARY APPENDICES TO
IT, MAY BE USED IN LIEU OF INDIVIDUAL APPLICATION FORMS.

(D)    THE COORDINATOR SHALL ADVISE PERSONS PROPOSING
PROJECTS OF THE VARIOUS PERMITS THAT MAY BE REQUIRED, AND
SHALL FURNISH RELEVANT INFORMATION TO THE APPLICANTS
CONCERNING THE REQUIRED PROCEDURES FOR OBTAINING THESE
PERMITS. ADVICE GIVEN BY THE COORDINATOR SHALL NOT
CONSTITUTE A WAIVER OF THE REQUIREMENT FOR ANY PERMIT OR
OF ANY CONDITION OR PROCEDURE REQUIRED FOR THE ISSUANCE
OF A PERMIT.

(E)    THE BOARD OF PUBLIC WORKS MAY ADOPT RULES AND
REGULATIONS APPROPRIATE TO IMPLEMENT THE PROVISIONS OF
THIS SUBTITLE, AND MAY APPOINT HEARING EXAMINERS TO
PERFORM THE DUTIES SET FORTH IN THIS SUBTITLE.

59. PROJECT REQUIRING LOCAL PERMIT; JOINT HEARING

(A)    A PERSON PROPOSING A PROJECT WHICH REQUIRES A
PERMIT FROM A LOCAL GOVERNMENT MAY, AT THE TIME HE
APPLIES FOR THE LOCAL PERMIT, REQUEST A JOINT HEARING
BEFORE THE LOCAL GOVERNMENT AND THE STATE AGENCIES FROM
WHICH A PERMIT IS REQUIRED. THE REQUEST SHALL BE IN
WRITING AND ACCOMPANIED BY A COPY OF THE APPLICATIONS FOR
EACH NECESSARY STATE PERMIT. A COPY OF THE LOCAL AND
STATE APPLICATIONS, ALL RELEVANT APPENDICES, AND THE
REQUEST FOR A JOINT HEARING SHALL, AT THE SAME TIME, BE
SENT TO THE COORDINATOR WHO SHALL FORWARD COPIES OF THE
RELEVANT PARTS OF THEM TO EACH STATE AGENCY FROM WHICH A
PERMIT IS REQUESTED.

(B)    THE LOCAL GOVERNMENT MAY APPROVE THE REQUEST
FOR A JOINT HEARING WITH RESPECT TO ANY OR ALL OF THE
STATE AGENCIES OR IT MAY DISAPPROVE THE REQUEST ENTIRELY,
IN ITS DISCRETION. IT SHALL MAKE AND GIVE WRITTEN NOTICE
OF ITS DECISION TO THE APPLICANT AND TO THE COORDINATOR
WITHIN 20 DAYS. THE COORDINATOR SHALL NOTIFY THE
AFFECTED STATE AGENCIES OF THE LOCAL GOVERNMENT'S
DECISION.
