AN ACT concerning
Montgomery County — Public Education
MC 69-75
FOR the purpose of clarifying [[certain election
procedures in certain primary elections; permitting
certain candidates to withdraw; and clarifying the
procedure for filling certain vacancies in the Board
of Education of Montgomery County; and generally]]
the number of candidates for the Montgomery County
Board of Education for which voters may vote in a
primary election; providing for cessation of a duly
nominated candidate; providing for filling a vacancy
on the board caused by any reason; and generally
relating to the nomination and election of members
of the Board of Education of Montgomery County.
BY repealing and re-enacting, with amendments,
Article 77 — Public Education
Section 36(b)(2) and (d)
Annotated Code of Maryland

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 36(b)(2) and (d) of Article 77 -
Public Education, of the Annotated Code of Maryland (1969
Replacement Volume and 1974 Supplement) be and it is
hereby repealed and re—enacted, with amendments, to read
as follows:

36.
(b) (2) If after the expiration of the time, as
aforesaid, there are more than two nominees for the
county Board of Education at large, respectively for each
member then to be elected, said board of supervisors of
elections shall provide the means whereby all duly
registered voters of Montgomery County, irrespective of
party affiliation, may vote for said nominees for the
county Board of Education at a primary election to be
held at the time and place for holding the primary
elections of the political parties. In taking the
