LAWS OF MARYLAND

[Ch. 330

(c) Any member in service who has attained
the age of 60 shall be retired on the first day of the
next calendar month after attaining [such] THAT age,
[excepting] EXCEPT the physician of the Department who
shall be retired on the first day of the next calendar
month after attaining the age of 70 and those employees
who were members as of July 1, 1965, and had attained the
age of 50 as of [such] THAT date who shall be retired not
later than on the first day of the calendar month next
following the attainment of age 64. The provisions of
this paragraph do not apply to the Superintendent.

(2)     (a) Upon retirement for service a member
shall receive a service retirement allowance which shall
be computed as one forty—fifth of his OR HER average
final compensation for each of the first twenty—five
years of creditable service, and one ninetieth of his OR
HER average final compensation for each year after the
first twenty—five years of creditable service[; provided
that the]. THE pension which [shall be] IS payable to any
member who has more than twenty—five years of creditable
service as of July 1, 1965, shall not be less than the
sum of pension, additional pension and supplemental
pension he OR SHE would have received upon service
retirement under the provisions of this subtitle in
effect prior to July 1, 1965.

(b)     Effective July 1, 1973, the provisions
of this subsection (shall be] ARE applicable to members
who retired prior to July 1, 1973.

(c)     Upon the death of any member who has
retired on a retirement service allowance:

(i) There shall be paid to the
surviving spouse, if [he leaves a surviving spouse] ANY,
to continue until remarriage of the surviving spouse, one
half of [his] THE DECEASED MEMBER'S retirement allowance;
or

(ii) If there [be] IS no eligible
surviving spouse, or if an eligible surviving spouse dies
or remarries before the youngest child of [such] THE
deceased member [shall have] HAS attained the age of
[eighteen] 18, then one half of the deceased member's
retirement allowance shall be paid to [his] THE child or
children, under [said] THAT age, divided in such manner
as the board in its discretion [shall determine]
DETERMINES to continue as a joint and survivorship
pension for the benefit of the child or children under
[said age] 18 until every child dies or attains [said
age] 13.

(3)    Upon the application of a member or of his OR
