does not leave a surviving [widow] SPOUSE but there is or
are a surviving child or children, any or all of whom are
under the age of 18 years, the pension shall be paid to
the surviving child or children who are under the age of
18 years, in equal amounts to each. Any payments made
to a [widow] SURVIVING SPOUSE under this section shall
terminate on either the death or remarriage of the
[widow] SURVIVING SPOUSE. In either event if there is
or are a child or children of the deceased member, who
are under the age of 18 years, the payments under this
section shall continue to [such] THE child or children in
equal amounts. Payments under this section to the
[widow] SURVIVING SPOUSE of a member shall continue for
the duration of HIS OR her natural life, unless HE OR she
remarries. If the [widow beneficiary] SURVIVING SPOUSE
has died or has remarried, as in this section specified,
payments to any surviving child shall terminate when he
OR SHE reaches the age of 18 years. If a pension is
paid under this section, it shall in no event be less
than [$100.00] $100 per month in the aggregate. A
[widow] SURVIVING SPOUSE, child, or children resulting
from any marriage contracted after the retirement of the
member are not eligible for any payments tinder the
provisions of this subtitle. For the purposes of this
section the remuneration of a retired member shall be
computed as it was in the year immediately preceding the
granting of the member's application for retirement.
With respect to a member who dies while in service the
word "remuneration" shall be computed as it was in the
year immediately preceding the date of his OR HER death.
53.
(1) (a) Any member may retire upon written
application to the board of trustees setting forth at.
what time he OR SHE desires to be retired, provided that
[such] THE member at the time [so] specified for [his]
retirement [shall have] HAS attained the age of 50 and
notwithstanding that during [such] THE period of
notification [he] THE MEMBER may have separated from
service, excepting the physician of the Department who
[shall] MUST have attained the age of 65 [at the time
specified for his retirement] IN ORDER TO RETIRE.
(b) The Superintendent of Maryland State
Police [is authorized], subject to the approval of the
board of trustees, [to] MAY order any member in service
who [shall have] HAS attained the age of 50 to retire on
the first day of the next calendar month after which
[such] THE member [shall be] IS notified of the
Superintendent's order[, provided, that said]. THE board,
before giving its approval [as aforesaid], shall first
give at least 10 days notice to the member concerned and
afford him an opportunity to be heard.
