(2)   Any officer employed and authorized by the
Secretary, or any State, county or municipal law
enforcement officer within the State may execute a
warrant to search for and seize any goods, business
records, merchandise, or fish caught, employed, used, or
possessed in connection with a violation of this section.
The officer or agent may arrest any person without a
warrant if he has probable cause to believe the person is
committing in his presence or view a violation of this
section or any rule or regulation issued pursuant to it.
The officer or agent who has made an arrest of a person
in connection with any violation may search the person or
premises at the time of arrest and seize any fish,
records, or property taken, used or employed in
connection with the violation.

(3)  An officer or agent of the Department shall hold
any goods, merchandise, fish, or records which have been
seized and dispose of them pursuant to §§ 4—1203 and
4—1204 of this title. However, the Secretary may direct
the transfer of fish seized to a qualified zoological,
educational, or scientific institution for safekeeping,
with costs assessable to the defendant.]

SECTION 2. AND BE IT FURTHER ENACTED, That new
Sections 4—2A01 through 4—2A09, inclusive, to be under
the new subtitle "2A. The Endangered Species of Pish
Conservation Act" be and they are hereby added to Article
— Natural Resources, of the Annotated Code of Maryland
(1974 Volume and 1974 Supplement) to read as follows:

Article - Natural Resources

2A. THE ENDANGERED SPECIES OF FISH CONSERVATION ACT
4-2A01.

(A)   IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE
MEANINGS INDICATED.

(B)     "CONSERVE" MEANS TO USE AIL METHODS AND
PROCEDURES FOR THE PURPOSE OF INCREASING THE NUMBER OF
INDIVIDUALS WITHIN SPECIES OR POPULATIONS UP TO THE
OPTIMUM CARRYING CAPACITY OF THEIR HABITAT AND
MAINTAINING THESE LEVELS. THESE METHODS AND PROCEDURES
INCLUDE ALL ACTIVITIES ASSOCIATED WITH SCIENTIFIC
RESOURCES MANAGEMENT SUCH AS RESEARCH, CENSUS, LAW
ENFORCEMENT, HABITAT ACQUISITION AND MAINTENANCE,
PROPAGATION, LIVE TRAPPING, AND TRANSPLANTATION,
INCLUDING THE PERIODIC OR TOTAL PROTECTION OF SPECIES OR
POPULATIONS AS WELL AS REGULATED TAKING. WITH RESPECT TO
ENDANGERED AND THREATENED SPECIES, THE TERM MEANS TO USE
