from the federal lists if he determines the same fish are
no longer threatened with statewide extinction.
(f) Subject to any federal law or regulation, or
any other State law, the Secretary by rule or regulation,
may permit the catching, exporting, transporting, or
possessing of any fish threatened with statewide
extinction, for zoological, educational, or scientific
purposes, and for propagating the fish in captivity for
preservation purposes.
(g) The Secretary shall conduct research on the
endangered species of fish in the State, and shall
utilize the land acquisition and other authorities vested
in his office to carry out a program in the State for
conserving, protecting, restoring, and propagating
selected State endangered fish species. In addition to
the land acquisition authorities vested in his office,
the Secretary may acquire by purchase, donation, or
otherwise, land or interest in land needed to carry out
the purposes of this section relating to conservation,
protection, restoration, and propagation of selected
State endangered fish species.
(h) The Governor shall review other programs he
administers and, to the extent feasible, utilize the
programs to further the purposes of this section. The
Governor also shall encourage other State and federal
agencies to utilize their authorities to further the
purposes of this section.
(i) In carrying out the programs authorized by this
section, the Secretary shall cooperate to the maximum
extent possible with the federal government, with other
states, and with counties within the State, and he may
enter into agreements with the counties to administer and
manage any area established under this program to
conserve the State's endangered fish species.
(j) The Secretary is authorized to issue rules and
regulations to implement this section.
(k) The provisions of this section do not apply
retroactively nor do they prohibit entry into the State
of fish lawfully imported into the United States or
caught or removed from another state. However, this
section does not permit catching and removing fish on the
endangered species list from another state into this
State.
(1) (1) Except as provided in subsection (f), any
person who violates the provisions of this section, or
any rule or regulation issued pursuant to it is guilty of
a misdemeanor and upon conviction is subject to a fine
