The provisions of present Art. 23, §263, which
relate to the filing of articles of
incorporation, are included in §5-304.

5-303. ACKNOWLEDGMENT AND ENTRY OF PLAN IN RECORD BOOK.

THE PLAN SHALL BE:

(1)   ENTERED IN THE RECORD BOOK REQUIRED BY
§5-307 OF THIS SUBTITLE; AND

(2)     ACKNOWLEDGED BY A MAJORITY OF THE
TRUSTEES.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first
sentence of Art. 23, §262.

The words "church," "plan," and "record book"
are defined in §5—301.

The last sentence of present Art. 23, §262,
which validates plans acknowledged before one
justice where two justices were required, is
deleted as obsolete. The deletion of this
language is in no way intended to effect the
validity of plans acknowledged by only one
justice of the peace from 1868, the year the
"two justices" requirement was first enacted,
to 1892, the year the requirement was changed
to one justice of the peace. These plans have
been validated by statute since 1892.

For provision relating to acknowledgments in
general, see Title 1 of this article.

5-304. ARTICLES OF INCORPORATION.

(A)   FILING FOR RECORD.

THE TRUSTEES SHALL FILE ARTICLES OF INCORPORATION
FOR RECORD WITH THE DEPARTMENT.

(B)   CONTENTS OF ARTICLES.

THE ARTICLES OF INCORPORATION SHALL CONTAIN:

(1)   THE PLAN OF THE CHURCH;

(2)    THE ADDRESS OF THE PRINCIPAL PLACE OF
WORSHIP OF THE CHURCH; AND

(3)   THE NAME AND ADDRESS OF THE RESIDENT
AGENT OF THE CHURCH.
