fee, and a certain annual inspection fee per acre up
to a certain maximum; providing for the issuance of
specific certificates or tags of plants that are
certified by the Department, and to require a
certain percentage fee of the gross sales price for
such inspection; clarifying the law as to treatment
or destruction of injurious nursery or orchard
stock; providing that violations of the provisions
of the Plant Pest Control Law are subject to certain
penalties in the Agriculture Article; and generally
relating to Plant Disease Control.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Sections 5-301, 5-302, 5-303, 5-304,
5-305, 5-306, 5-307, 5-309, 5-310, 5-311, and 5-312 of
Article — Agriculture, of the Annotated Code of Maryland
(19 74 Volume and 1974 Supplement) be and they are hereby
repealed and re—enacted, with amendments, to read as
follows:

Article — Agriculture

5-301.

(a) In this subtitle the following words have the
meanings indicated.

(B)        "BROKER" MEANS ANY PERSON, [[OTHER THAN A

NURSERYMAN OR DEALER,]] WHO SOLICITS, TAKES ORDERS, SELLS
OR DISTRIBUTES NURSERY STOCK IN THE STATE OTHER THAN A
NURSERYMAN OR DEALER.

[(b)] (C) "Dealer" means any person, except a
nurseryman OR BROKER, who buys, collects, or otherwise
acquires wild plants or nursery stock for the purpose of
[[reselling]] SELLING or distributing them.
