established in excess of a maximum of [70] 55 miles per
hour on the highways of this State.
Posted maximum speed limits which were - lawfully in
effect on the date prior to January 1, [1971 shall be]
1975 ARE the maximum lawful speeds even though they are
different from the maximum limits specified above in this
subsection. The maximum speed limits set forth in this
subsection may be altered as authorized in §§ 11-802 and
11-803.
11-802.
Whenever the [State Roads Commission] STATE HIGHWAY
ADMINISTRATION determines upon the basis of an
engineering and traffic investigation that any maximum
speed hereinbefore set forth is greater or less than is
reasonable or safe under the conditions found to exist at
any intersection or other place or upon any part of the
State highway system, the Commission may determine and
declare a reasonable and safe maximum limit thereat NOT
TO EXCEED 55 MILES PER HOUR, which [shall be] IS
effective when appropriate signs giving notice thereof
are erected[, but]. HOWEVER, no engineering and traffic
investigation [shall] MAY be required to conform a posted
maximum speed limit which was lawfully in effect on the
date prior to January 1, [1971] 1975, to a different
maximum lawful speed limit specified in § 11—801(b).
The maximum speed limit may be declared to be effective
at all times or at such times as are indicated upon the
[said] signs; and differing limits may be established for
different times of day, different types of vehicles,
varying weather conditions, and other factors bearing on
safe speeds, which shall be effective when posted upon
appropriate fixed or variable signs.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1975.
