AN ACT concerning

Oysters and Clams — Licenses

FOR the purpose of authorizing the catching of oysters
and clams for commercial purposes without a license
by dredge, handscrape or hydraulic dredge that is
licensed by the Department of Natural Resources.

BY repealing and re—enacting, with amendments,

Section 4-10 04 (a)
Annotated Code of Maryland
(1974 Volume and 1974 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 4-1004 (a) of Article - Natural
Resources, of the Annotated Code of Maryland (1974 Volume
and 1974 Supplement) be and it is hereby repealed and
re-enacted, with amendments, to read as follows:

Article — Natural Resources

4-1004.

(a) A person may not catch oysters or clams for
commercial purposes in the waters of the State unless he
first obtains a license, A person may catch up to 1
bushel of oysters from the natural oyster bars of the
State for his own use and consumption without a license,
in places and at times prescribed by rule or regulation
of the department. THE LICENSING REQUIREMENTS OF THIS
SUBSECTION DO NOT APPLY TO A PERSON CATCHING OYSTERS OR
CLAMS COMMERCIALLY BY DREDGE, HANDSCRAPE, OR HYDRAULIC
DREDGE THAT IS LICENSED PURSUANT TO SUBSECTION (C).

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1975.
