SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 130(p) of Article 43 - Health, of
the Annotated Code of Maryland (1971 Replacement Volume
and 1974 Supplement) be and it is hereby repealed and
re—enacted, with amendments, to read as follows:
Article 43 - Health
130.
(p) Any person whose license has been
revoked or suspended by the Commission or any person
REPRIMANDED OR placed on probation under this section,
may have a judicial review of the Commissions decision.
He may enter an appeal to the Baltimore City Court, or in
the circuit court in the county in which the charges
originated or in which the physician maintains his
principal office and serve notice of the appeal on the
Commission within 30 days after the filing of the
certificate or ORDER of [the] revocation, suspension,
probation, or reprimand. THE COMMISSION HAS A RIGHT OF
APPEAL TO THE COURT OF SPECIAL APPEALS OF MARYLAND FROM
ANY ORDER OF THE BALTIMORE CITY COURT OR OF THE CIRCUIT
COURT OF ANY COUNTY WHICH ORDER SHALL REVERSE OR MODIFY
ANY ORDER OF THE COMMISSION OR SHALL REMAND ANY MATTER TO
THE COMMISSION.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1975.
