programs to further the purposes of this section. The
Governor also shall encourage other State and federal
agencies to utilize their authorities to further the
purposes of this section.

(i) In carrying out the programs authorized by
this section, the Secretary shall cooperate to the
maximum extent possible with the federal government, with
other states, and with counties within the State, and he
may enter into agreements with the counties to administer
and manage any established area under this program to
conserve the State's endangered wildlife species.

(j) The Secretary is authorized to issue rules and
regulations to implement this section.

(k) The provisions of this section do not apply
retroactively or prohibit entry into the State of
wildlife lawfully imported into the United States, or
hunted or removed from another State. In addition, this
section does not permit hunting and removing wildlife on
the endangered species list from another state into the
State.

(1) (1) Except as provided in subsection (f),
any person who violates the provisions of this section,
or any rule or regulation issued pursuant to it is guilty
of a misdemeanor and, upon conviction, is subject to a
fine not exceeding $1,000.

(2)    Any officer employed and authorized by
the Secretary, or any State, county, or municipal law
enforcement officer within the State may execute a
warrant to search for and seize any goods, business
records, merchandise, wildlife hunted, employed, used, or
possessed in connection with a violation of this section.
The officer or agent may arrest any person without a
warrant if he has probable cause to believe the person is
committing in his presence or view a violation of this
section or a regulation issued pursuant to it. The
officer or agent who has made an arrest of a person in
connection with any violation may search the person or
premises at the time of arrest and seize any wildlife,
records, or property taken, used or employed in
connection with the violation.

(3)    An officer or agent of the Department
shall hold any goods, merchandise, wildlife, or records
which have been seized and dispose of them pursuant to §§
10-100 5 and 10-1006 of this title. However, the
Secretary may direct the transfer of wildlife seized to a
qualified zoological, educational, or scientific
institution for safekeeping, or other appropriate
disposition with costs, upon conviction, assessable to
