COUNTY LOCAL LAWS

this Chapter above the amount charged as rent for
such dwelling unit on the effective date of this Act
except in accordance with the provisions of this
Article; to provide that the lawful base rent for
all dwelling units covered by this Chapter shall be
the rent legally charged, received, and paid as of
the effective date of this Act; to provide that it
shall be unlawful and a violation of this Chapter
for any landlord to demand or receive any rent for
any dwelling unit covered by this Chapter in excess
of the lawful base rent as established or adjusted
by the provisions of this Article or by any rule,
regulation, decision, or order of the Executive
Director or Commission which violation shall be a
misdemeanor punishable by a Thousand Dollar
($1,000.00) fine enforceable in civil attachment
proceedings; to provide that the Executive Director
of the Office of Landlord—Tenant Affairs, subject to
advice and recommendations of the Commission on
Landlord—Tenant Affairs, shall formulate rules and
regulations relating to rent control which shall
become effective after approval or amendment by the
County Council; to provide for the increase of rent
above the lawful base rent; to provide that the
Commission on Landlord—Tenant Affairs shall develop
a system of rent control or guidelines to be adopted
by the County Council after public hearing upon
reasonable notice; to provide that it shall be a
misdemeanor punishable by a Thousand Dollar
($1,000.00) fine enforceable in civil attachment
proceedings to fail to comply with any of the
provisions of this Article or any rule, regulation,
decision, order, or summons of the Executive
Director or Commission; to provide that certain
dwelling units be exempted from the provisions of
this Article; and to provide for the adoption of
Chapter 93A (Chapter 29 of the Montgomery County
Code 1972) by incorporated towns, villages, or
municipalities and for the enforcement thereof by
the County.

BE IT ENACTED BY THE COUNTY COUNCIL FOR MONTGOMERY
COUNTY, MARYLAND, that -

Sec. 1. Chapter 93A of the Montgomery County Code
1965, as amended (Chapter 29 of the Montgomery County
Code 1972), title "Fair Landlord—Tenant Relations," by
and the same is hereby amended to add a new Article V,
title "Rent Controls," to read as follows:
