functions and activities pertaining to the review of
building permits, occupancy permits and licensing of
facilities for compliance with fire prevention law. In
exercising these functions, the Director shall consult
with the Fire Marshal in all matters pertaining to the
interpretation or revision of the fire prevention law.

(E) SOLID WASTE MANAGEMENT. MANAGEMENT OF THE
SOLID WASTE PROGRAM INVOLVING REFUSE COLLECTION AND
DISPOSAL - INCLUDING SANITARY LANDFILL AND INCINERATOR
OPERATIONS AND OTHER RELATED FUNCTIONS.

Sec. 3. Sections 73—12, title "Department of Public
Works - Functions generally,"; 73-13, title
"Same—Direction; appointment of director," and 73—14,
title "Same—Divisions," Chapter 73, title
"Administration," of the Montgomery County Code 1965, as
amended, be and are hereby repealed.

Sec. 4. Section 87-22, Chapter 87, title "Garbage
and Refuse," subtitle "Refuse Collection District," of
the Montgomery County Code 1965, as amended, be and is
hereby amended to substitute the words "Director of the
Department of Environmental Protection" in place of the
words "Director of Public Works" wherever they appear.

Sec. 5. A new Section 2—16F, Chapter 2, title
"Administration," subtitle "Department of Fire/Rescue
Services," is hereby added to the Montgomery County Code
1965, as amended, to read as follows:

2-16F. DEPARTMENT OF FIRE/RESCUE SERVICES.

THERE IS HEREBY ESTABLISHED A DEPARTMENT OF
FIRE/RESCUE SERVICES UNDER THE IMMEDIATE DIRECTION OF A
DIRECTOR WHO SHALL BE APPOINTED BY THE COUNTY EXECUTIVE
SUBJECT TO CONFIRMATION BY THE COUNTY COUNCIL.

THE DEPARTMENT SHALL HAVE THE FOLLOWING FUNCTIONS
AND RESPONSIBILITIES:

(A)    FIRE PREVENTION. ALL FUNCTIONS AND ACTIVITIES
PERTAINING TO FIRE PREVENTION, INCLUDING THE FUNCTIONS
AND ACTIVITIES OF THE FIRE MARSHAL.

(B)    COMMUNICATIONS. OPERATION OF FIRE/RESCUE
DISPATCH SERVICE.

(C)    TRAINING OF FIRE/RESCUE SERVICES.

(D)    THE DIRECTOR SHALL SERVE AS EXECUTIVE
SECRETARY TO THE FIRE BOARD, PROVIDING COORDINATION WITH
AND ASSISTANCE TO THE FIRE BOARD IN THE BOARD'S
RESPONSIBILITIES AND DUTIES AS PRESCRIBED BY LAW.
