application to other persons or circumstances. It is
hereby declared to be the legislative intent that this
Act would have been adopted if such illegal, invalid or
unconstitutional provision, sentence, clause, section or
part had not been included therein, and if the person or
circumstances to which the Act or any part thereof is
inapplicable had been specifically exempted therefrom.

Sec. 4.

The County Council hereby declares that an emergency
exists and that this legislation is necessary for the
immediate protection of the public health and safety.
Therefore, this emergency legislation shall take effect
on the date en which it becomes law.

Chapter 18

AN ACT to repeal and re—enact, with amendments, Section
106-16, title "Pare rates", of Chapter 106, title
"Taxicabs", to the Montgomery County Code 1965, as
amended, to increase the taxicab fare within
Montgomery County from $.60 for the first mile to
$.60 for the first three—fifths of a mile.

BE IT ENACTED BY THE COUNTY COUNCIL FOR MONTGOMERY COUNTY,
MARYLAND, that -

Sec. 1. Chapter 106—16, title "Fare rates", of
Chapter 106, title "Taxicabs", is hereby repealed and
re—enacted with amendments to read as follows:

Section 106—16. Fare Rates.

Each taxi meter shall be set to register fares on
the following schedule of rates:

(a) Rate for not more than two passengers:

For the first THREE-FIFTHS OF A mile............$.60

For each succeeding one—fifth of a mile.........$.10

For such waiting time beginning five minutes after
the time for which the taxicab has been called or is
available to the customers and for such time while
such taxicab is stopped, has slowed to a speed of
less than seven miles per hour..........$4.0 per hr.

Such hourly rate is in lieu of the above mileage
rate for such periods as the taxicab is stopped, waiting
