COUNTY LOCAL LAWS

Chapter 14

AN ACT to amend Chapter 93A, title "Fair Landlord—Tenant
Relations," of the Montgomery County Code 1965, as
amended, to repeal and re—enact, with amendments,
Section 93A-4, title "Definitions," of Article I,
title "General Provisions," to add a new subsection
(h) and to redesignate subsections (h) through (o),
inclusive, to provide a definition for the term
"inspection" or "inspections" by repealing and
re—enacting, with amendments Article III, title
"Licensing of Rental Facilities," to provide for the
licensing of rental facilities in Montgomery County,
for penalties for failure to license or comply with
orders of the Commission on Landlord—Tenant Affairs,
for license fees, for the inspection of rental
facilities, for procedures for the grant, denial,
suspension, revocation, terms, and transfer of
licenses, for mandatory administrative hearing prior
to the denial, suspension, or revocation of a
license, and for appeals of actions of the Office on
Landlord-Tenant and Commission on Landlord-Tenant
Affairs.

BE IT ENACTED BY THE COUNTY COUNCIL FOR MONTGOMERY
COUNTY, MARYLAND, that -

Sec. 1. Section 93A—4, title "Definitions," Chapter
93A, title "Fair Landlord—Tenant Relations," of the
Montgomery County Code 1965, as amended, is hereby
repealed and re—enacted, with amendments, to read as
follows:

93A-4. Definitions.

(h) "Inspection" or "inspections" shall mean an
examination of a rental facility or any part thereof as
the Executive Director shall deem appropriate to carry
out the purposes of this Chapter.

(i) "Landlord" shall mean the owner, the owner's
agent, lessor or sublessor of the dwelling unit or the
property of which it is a part and, in addition, means
any person authorized to exercise any aspect of the
management of the premises except those persons engaged
solely in custodial and maintenance functions.

(j) "Lease" shall mean any written agreement which
establishes or modifies the terms, conditions, rules,
regulations or any other provisions concerning the use
and occupancy of a dwelling unit.
