COUNTY LOCAL LAWS

EXTERIOR APPEARANCE OF A STRUCTURE IN THE HISTORIC
DISTRICT, SHALL FILE AN APPLICATION FOR THE SAME WITH THE
HISTORIC DISTRICT COMMISSION AT THE DEPARTMENT OF PUBLIC
WORKS, WHICH SHALL FORWARD SAID APPLICATION TOGETHER WITH
ALL MAPS, PLANS AND ALL OTHER DATA TO THE HISTORIC
DISTRICT COMMISSION. EACH APPLICATION SHALL INCLUDE ALL
NECESSARY DATA REQUIRED BY THE RULES OF THE HISTORIC
DISTRICT COMMISSION AND SHALL BE ADVERTISED BY THE
DEPARTMENT OF PUBLIC WORKS AT THE EXPENSE OF THE
APPLICANT, IN SUCH MANNER AS PROVIDED FOR IN THE RULES OF
THE COMMISSION.

3.     IN REVIEWING AN APPLICATION AND PLANS
THE COMMISSION SHALL GIVE CONSIDERATION TO:

(A)    THE HISTORIC OR ARCHITECTURAL

VALUE OR SIGNIFICANCE OF THE STRUCTURE AND ITS
RELATIONSHIP TO THE HISTORIC VALUE OF THE SURROUNDING
AREA.

(B)    THE RELATIONSHIP OF THE EXTERIOR

ARCHITECTURAL FEATURES OF SUCH STRUCTURE TO THE REMAINDER
OF THE STRUCTURE AND TO THE SURROUNDING AREA.

(C)    THE GENERAL COMPATIBILITY OF

EXTERIOR DESIGN, ARRANGEMENT, TEXTURE, AND MATERIALS
PROPOSED TO BE USED.

(D)    TO ANY OTHER FACTORS INCLUDING

AESTHETIC FACTORS WHICH THE COMMISSION DEEMS TO BE
PERTINENT.

4.     THE COMMISSION SHALL PASS ONLY ON
EXTERIOR FEATURES OF A STRUCTURE AND SHALL NOT CONSIDER
INTERIOR ARRANGEMENT; NOR SHALL IT DISAPPROVE
APPLICATIONS EXCEPT IN REGARD TO THE CONSIDERATIONS SET
FORTH ABOVE.

5.     IT IS THE INTENT OF THIS ACT THAT THE
COMMISSION BE STRICT IN ITS JUDGEMENT OF PLANS FOR
STRUCTURES DEEMED TO BE VALUABLE ACCORDING TO STUDIES
PERFORMED FOR DISTRICTS OF HISTORIC OR ARCHITECTURAL
VALUE. IT IS ALSO THE INTENT OF THIS ACT THAT THE
COMMISSION SHALL BE LENIENT IN ITS JUDGEMENT OF PLANS FOR
STRUCTURES OF LITTLE HISTORIC VALUE OR FOR PLANS FOR NEW
CONSTRUCTION EXCEPT WHERE SUCH PLANS WOULD SERIOUSLY
IMPAIR THE HISTORIC OR ARCHITECTURAL VALUE OF SURROUNDING
STRUCTURES OR THE SURROUNDING AREA. IT IS NOT THE INTENT
OF THIS ACT TO LIMIT NEW CONSTRUCTION, ALTERATION, OR
REPAIRS TO THE ARCHITECTURAL STYLE OF ANY ONE PERIOD.

6.            SPECIAL CONSIDERATIONS.

(A) IN THE CASE OF AN APPLICATION FOR
