CONTEXT.
REVISOR'S NOTE: This subsection is the standard
introductory sentence to a definition section
used in this article.
(B) "BUSINESS" MEANS ANY LAWFUL ACTIVITY, EXCEPT A
FARM OPERATION, CONDUCTED PRIMARILY:
(1) FOR THE PURCHASE, SALE, LEASE, AND RENTAL
OF PERSONAL PROPERTY AND OF LAND, AND FOR THE
MANUFACTURE, PROCESSING, OR MARKETING OF PRODUCTS,
COMMODITIES, OR ANY OTHER PERSONAL PROPERTY;
(2) FOR THE SALE OF SERVICES TO THE PUBLIC;
OR
(3) BY A NONPROFIT ORGANIZATION.
REVISOR'S NOTE: This subsection presently appears as
Art. 21, §12-201(e) of the Code. The present
reference to "real property" is proposed for
deletion and "land" is substituted in this and
subsequent provisions of the subtitle. "Peal-
property" is not defined anywhere in this
article while "land" and "property" are
defined as "real property or any interest
therein or appurtenant thereto"; see §1-101(f)
and (k). Use of "property," however,
throughout this subtitle would cause confusion
since in this subtitle, in contrast to others
in the article, the phrase "personal property"
appears. Consequently, "land" is substituted
where ever "real property" presently appears.
The only other changes are in style.
(C) "DISPLACED PERSON" MEANS ANY PERSON WHO MOVES
FROM LAND, OR MOVES HIS PERSONAL PROPERTY FROM LAND, AS A
RESULT OF THE WHOLE OR PARTIAL ACQUISITION OF THE LAND,
OR AS THE RESULT OF A WRITTEN ORDER OF THE ACQUIRING
AGENCY TO VACATE LAND FOR A PUBLIC WORKS PROGRAM OR
PROJECT UNDERTAKEN BY THE PUBLIC OR PRIVATE AGENCY.
REVISOR'S NOTE: This subsection presently appears as
Art. 21, §12-201(d) of the Code. "Real
property" is proposed for deletion and "land"
substituted for the reasons explained in the
revisor's note to §12—201(b). The only other
changes are in style.
(D) "FARM OPERATION" MEANS ANY ACTIVITY CONDUCTED
SOLELY OR PRIMARILY FOR THE PRODUCTION OF ONE OR MORE
AGRICULTURAL PRODUCTS OR COMMODITIES, INCLUDING TIMBER
FOR SALE OR HOME USE, AND CUSTOMARILY PRODUCING THESE
