COUNTY LOCAL LAWS

WHO IS THEN LIVING WHICH IS IN EXCESS OF HIS UNRESTRICTED
BENEFITS WILL BE CANCELLED. AS OF THE DATE OF FAILURE TO
MEET THE FULL CURRENT COSTS OF THE PLAN AND PRIOR TO THE
DATE FULL CURRENT COSTS OF THE PLAN ARE AGAIN MET, NO
COVERAGE MAY BE PROVIDED FOR A RESTRICTED PARTICIPANT
WHICH WOULD RESULT IN HIS COVERAGE EXCEEDING HIS
UNRESTRICTED BENEFITS.

(C)    SOLELY FOR THE PURPOSES OF THIS SECTION, ANY
CHANGE IN THE TERMS OF THE PLAN RESULTING IN A
SUBSTANTIAL REDUCTION IN COUNTY COSTS SHALL HAVE THE SAME
EFFECT AS A TERMINATION OF THE PLAN UNLESS THE UNITED
STATES COMMISSIONER OF INTERNAL REVENUE HAS RULED THAT
SUCH CHANGE WILL NOT RESULT IN THE FAILURE OF THE PLAN TO
MEET THE REQUIREMENTS OF SECTION 401(A) OF THE FEDERAL
INTERNAL REVENUE CODE.

(D)    NO COVERAGE MAY BE PROVIDED FOR A RESTRICTED
PARTICIPANT ON OR AFTER TERMINATION OF THE PLAN WHICH
WOULD RESULT IN HIS COVERAGE EXCEEDING HIS UNRESTRICTED
BENEFITS.

(E)    THE TERMS OF THIS SUBSECTION SHALL PREVAIL
OVER ANY OTHER TERMS OF THE PLAN THAT MAY BE INCONSISTENT
HEREWITH.

SECTION 2. AND BE IT FURTHER ENACTED, That in
accordance with the provisions of Section 21—301 of the
Anne Arundel County Code (1967 Edition and Supplements),
Title 21, "General Provisions, Penalties and Rules of
Interpretation", Subtitle 3, "Rules of Interpretation",
the catchlines or section headings of the several
sections of this ordinance are intended as mere
catchwords to indicate the contents of said section, and
shall not be deemed or taken to be titles of such
sections nor as any part of said section.

SECTION 3. AND BE IT FURTHER ENACTED, That if any
provision of this ordinance or the application thereof to
any person or circumstance is held invalid for any
reason, such invalidity shall not affect the other
provisions or any other application of this ordinance,
which can be given effect without the invalid provisions
or application, and to this end, all the provisions of
this ordinance are hereby declared to be severable.

SECTION 4. AND BE IT     FURTHER ENACTED, That this

Ordinance shall take effect   forty—five (45) days from the
date it becomes law.
