be and the same is hereby repealed, and the following
subsection (a) is enacted and adopted in lieu thereof:
"(A) COMMENCING IN THE YEAR 1973, THE ELECTION FOR
MAYOR SHALL BE HELD ON THE FIRST MONDAY OF MAY IN EACH
ODD-NUMBERED YEAR, AND THE PERSON SO ELECTED SHALL SERVE
AS MAYOR FOR A TERM OF TWO YEARS OR UNTIL HIS SUCCESSOR
IS ELECTED AND QUALIFIES. AT THE SAME ELECTION HELD IN
EACH ODD-NUMBERED YEAR, ONE COUNCILMAN SHALL BE ELECTED
AND HE SHALL SERVE FOR A TERM OF TWO YEARS OR UNTIL HIS
SUCCESSOR IS ELECTED AND QUALIFIES. COMMENCING IN MAY,
1974, ONE COUNCILMAN SHALL BE ELECTED AT AN ELECTION HELD
ON THE FIRST MONDAY OF MAY IN EACH EVEN-NUMBERED YEAR AND
HE SHALL SERVE FOR A TERM OF TWO YEARS OR UNTIL HIS
SUCCESSOR IS ELECTED AND QUALIFIES. ANY APPOINTMENT OR
ELECTION TO FILL A VACANCY OCCURRING BEFORE THE
EXPIRATION OF A TERM SHALL BE FOR THE REMAINDER OF THE
EXPIRED TERM."
The other subsection, viz. subsection (b) , of section 3
of the Charter shall remain unaffected by this amendment.
The above amendment shall take effect on the
fiftieth (50th) day after the adoption of this
resolution, unless a petition to submit the amendment on
referendum to the voters of the Town is submitted as
prescribed in §13 of Art. 23A of the Annotated Code of
Maryland, 1966 replacement volume.

CHAPTER AMENDMENT RESOLUTION NO. 5
A RESOLUTION of the Mayor and Town Council of
Lonaconing, Allegany County, Maryland, adopted pursuant
to the authority contained in Article 11—E of the
Constitution of the State of Maryland and Section 13 of
Article 23A of the Annotated Code of Maryland, entitled
"Municipal Corporations," titled "A resolution to amend
the Charter of the Town of Lonaconing, (1963 Edition)
being section 385, "Voters," of the Town Charter, by
repealing and reenacting section 385 of said Charter,
specifying qualifications of voters.
