MUNICIPAL CHARTERS

budgets; specifies exact procedures for the borrowing of
money for public improvements and provides for public
hearings thereon; specifies exact procedures for the
imposition of special assessments and provides for public
hearings thereon; provides for the publication of a
specimen ballot before any election of councilmen and for
a special election to fill vacancies on the city council;
and provides that all taxable assessed property within
the limits of the city shall be taxed at a rate not to
exceed fifty cents ($.50) per One Hundred Dollars
($100.00) (the present tax rate limits) requires public
offers to purchase before condemnation of property for
public improvements;

SECTION 1. BE IT RESOLVED, ENACTED AND ORDAINED BY
THE FRUITLAND COMMISSION OF THE TOWN OF FRUITLAND,
MARYLAND, by virtue of the authority, granted in Article
11E of the Constitution of Maryland, and Section 13 of
Article 23A of the Annotated Code of Maryland (1966
Replacement Volume) title Corporations Municipal
"Sub-Title Home Rule" that Sections 109 through 119 AW
both inclusive of the Charter of the Town of Fruitland,
as set forth in the Code of Public Local Laws of Wicomico
County, (1965 Edition) be and the same are hereby
repealed and that new Sections 109 through 119 be
re-enacted in place thereof to read as follows:

109. INCORPORATION; BODY CORPORATE

THE INHABITANTS OF THE CITY OF FRUITLAND IN WICOMICO
COUNTY, MARYLAND, ARE HEREBY CONSTITUTED A BODY CORPORATE
BY THE NAME "THE CITY OF FRUITLAND," AND BY THAT NAME
SHALL HAVE PERPETUAL SUCCESSION, SUE AND BE SUED, HAVE
AND USE A COMMON SEAL WHICH MAY BE ALTERED AT PLEASURE,
AND HAVE ALL THE POWERS AND PRIVILEGES NOW OR HEREAFTER
AUTHORIZED BY THE STATE OF MARYLAND.

109A. CORPORATE BOUNDARIES

THE LIMITS OF THE CITY SHALL BE AS FOLLOWS:
BEGINNING FOR THE SAME AT A POINT IN THE CENTER LINE OF
PRESENT U. S. ROUTE 13 SAID POINT OF BEGINNING BEING ALSO
THE CENTER LINE OF A STREAM OR DITCH WHICH FORMS THE
EASTERLY BOUNDARY OF THE CROWN CORK AND SEAL COMPANY
PROPERTY AND RUNNING THENCE (1) IN AN IRREGULAR SOUTHERLY
AND THEN EASTERLY DIRECTION BY AND WITH SAID DITCH UNTIL
IT INTERSECTS WITH A LINE DROWN SOUTHWESTERLY AND ON THE
SAME COURSE AS THE SOUTHEASTERLY LINE OF THE LLOYD T.
BROWN PROPERTY; THENCE (2) BY AND WITH THE EXTENDED LINE
OF THE SAID LLOYD T. BROWN PROPERTY BUT REVERSING THE
DIRECTION THEREOF (WHICH COURSE IS NORTH 66° 25' EAST BY
A 1922 SURVEY) TO AND ACROSS MEADOWBRIDGE ROAD TO THE
SOUTHWESTERLY CORNER OF THE SAID LLOYD T. BROWN PROPERTY;
