3240                                    EXECUTIVE ORDERS

requirements of Sunday closings or limited Sunday
operations for such food stores affect and are
affected by the use of energy resources;

NOW, THEREFORE, I, MARVIN MANDEL, GOVERNOR OF THE STATE
OF MARYLAND BY VIRTUE OF THE AUTHORITY VESTED IN ME
BY ARTICLE 41, SECTION 15B OF THE ANNOTATED CODE OF
MARYLAND (1971 REPLACEMENT VOLUME AND 1973
CUMULATIVE SUPPLEMENT, AS AMENDED BY CHAPTER 1 OF
THE ACTS OF 1973, SECOND SPECIAL SESSION), INCLUDING
PARTICULARLY THE AUTHORITY TO SUSPEND AND MODIFY
EXISTING STANDARDS AND REQUIREMENTS AFFECTING OR
AFFECTED BY THE USE OF ENERGY RESOURCES, INCLUDING
THOSE RELATING TO THE HOURS AND DAYS DURING WHICH
COMMERCIAL ESTABLISHMENTS MAY REMAIN OPEN, AND
BECAUSE I AM ADVISED AND INFORMED THAT THE FOLLOWING
IS REASONABLE AND NECESSARY IN VIEW OF THE SITUATION
OF EMERGENCY, DO HEREBY PROCLAIM AND ISSUE THE
FOLLOWING ORDER, EFFECTIVE AS PROVIDED IN PARAGRAPH
FOUR OF THIS ORDER.

1.    Any retail store primarily engaged in
the sale of food and non-alcoholic beverages may
remain open between the hours of 12:01 a.m., and
11:59 p.m. on Sunday, February 10, 1974,
notwithstanding the provision of any State, county
or municipal law to the contrary.

2.    Any such law requiring the closing of
such stores, or limiting the number of employees who
may work in order for such a store to remain open on
Sunday is hereby suspended for the period commencing
12:01 a.m. to 11:59 p.m., Sunday, February 10, 1974.

3.    Nothing in this Order shall require any
such store to remain open or to affect any agreement
between such a store and its employees relating to
hours of work.

4.    I hereby declare that the situation to
which this Order is directed is an emergency, and
that it is not feasible to secure the approval of
the Committee on Administrative, Executive and
Legislative Review prior to the taking effect of
this Order. Therefore, this Order shall become
effective as of 12:01 a.m., Sunday, February 10,
1974, subject to reversal or modification by the
committee when convened.

5.    A copy of this Order shall be delivered
immediately to the Chairman of the Committee on
Administrative, Executive and Legislative Review or
in his absence, the Vice Chairman.
