3218                                    EXECUTIVE ORDERS

BY ARTICLE 41, SECTION 15B OF THE ANNOTATED CODE OF
MARYLAND (1971 REPLACEMENT VOLUME AND 1973
CUMULATIVE SUPPLEMENT, AS AMENDED BY CHAPTER 1 OF
THE ACTS OF 1973, SECOND SPECIAL SESSION), AND
PURSUANT TO THE PROVISIONS OF ARTICLE 41, SECTION
15CD OF THE ANNOTATED CODE OF MARYLAND (1971
REPLACEMENT VOLUME AND 1973 CUMULATIVE SUPPLEMENT),
DO HEREBY PROCLAIM AND ISSUE THE FOLLOWING ORDER,
EFFECTIVE 12:01 A.M., JANUARY 10, 1974:

The Executive Order of November 16, 1973, lowering
maximum speed limits on highways within the State, is
hereby amended and re—promulgated as follows:

"1. Except where a lesser maximum speed
limit is required by or established in accordance
with Article 66—1/2 of the Annotated Code of
Maryland, [fifty] FIFTY-FIVE miles per hour is
declared to be the maximum lawful speed on the
highways within the State; and, subject only to the
exemptions and privileges otherwise granted by law
to authorized emergency vehicles, no person shall
operate a vehicle in excess of (fifty] FIFTY—FIVE
miles per hour on any highway within the State.

"2. Pursuant to my authority, as aforesaid,
to establish and implement standards for the
conservation of energy resources, [fifty] FIFTY—FIVE
miles per hour is declared to be the maximum
reasonable speed for the purposes of Article 66—1/2,
§ 11—801(a) of the Annotated Code of Maryland; and,
any person operating a vehicle in excess of [fifty]
FIFTY—FIVE miles per hour on any highway within the
State shall be deemed to be operating such vehicle
at a speed which is unreasonable within the meaning
of Article 66-1/2, § 11-801(a) of the Annotated Code
of Maryland.

"3. Pursuant to my authority, as aforesaid,
to modify existing standards and requirements
affecting the use of energy resources, the standards
and requirements set forth in the provisions of
Article 66-1/2, §§ 11-801 (b) (4), and 11-801(b)(5) of
the Annotated Code of Maryland are hereby modified
to establish [fifty] FIFTY—FIVE miles per hour as
the maximum lawful speed on the respective highways
described in said provisions.

"4. Notwithstanding the provisions of
Article 66-1/2, §§ 11-801(c), 11-802 and 11-803 of
the Annotated Code of Maryland, or of any other
provisions of State or local law, no maximum speed
limit may be established by any State or local
