provision relating to appeals to the State Courts of
Appeal.

Senate Bill 1070, which was enacted by the General
Assembly and signed by me on May 31, 1974, accomplishes
the same purposes as Senate Bill 489, in addition to
making several other corrections and clarifications in
the laws concerning courts and judicial proceedings.

Therefore, it is unnecessary for me to sign Senate
Bill 489.

Senate Bill No. 548 — Abandoned Railroad Property
AN ACT concerning

Transportation — Acquisition of Abandoned
Railroad Property

FOR the purpose of authorizing the Secretary of
Transportation, on behalf of the State, to acquire
certain abandoned railroad property , giving the

Secretary__the right of purchase under right of

condemnation, for transportation purposes under
certain circumstances, limiting the power of
railroad companies to dispose of such property, and
relating generally to abandoned railroad property.

Dear Mr. President:

In accordance with Article II, Section 17 of the
Maryland Constitution, I have today vetoed Senate Bill
548.

This bill authorizes the Secretary of Transportation
to acquire, by right of condemnation, certain unused
railroad property. It also grants to the Secretary a
preferential right — or "right of first refusal" — to
