Optometry define disorders characterized by lapses of
consciousness or which result in a corrected visual
acuity which fails to comply with the requirements of §
6-110.1 of this Article.
(b) All physicians and other persons authorized to
diagnose, detect, or treat disorders and disabilities
defined by the State Department of Health and Mental
Hygiene [shall] MAY report to the medical advisory board
of the [Department of Motor Vehicles] MOTOR VEHICLE
ADMINISTRATION and to the person who is the subject of
each report, in writing, the full name, date of birth and
address of every person over 15 years of age having any
such specified disorder or disability [within 10 days of
diagnosis], HOWEVER, NO REPORT SHALL BE MADE FROM
INFORMATION DERIVED FROM THE DIAGNOSIS OR TREATMENT OF
ANY PERSON UPON WHOM A CONFIDENTIAL OR PRIVILEGED
RELATIONSHIP HAS BEEN CONFERRED BY LAW, UNLESS AUTHORIZED
BY THE PERSON IN WRITING.
(c) The Administration upon receipt of such
information and as soon as practicable shall arrange for
an examination of each such person who holds a driver's
license, and if the person examined fails to meet the
requirements of Subtitle 6 the Administration shall
cancel any driver's license held by such person.
(d) The reports required by this section shall be
confidential and used solely for the purpose of
determining the qualifications of any person to drive a
motor vehicle on the highways of this State. No civil or
criminal action may be brought against any person or
agency who provides the information required herein[. ] ,
AND WHO DOES NOT VIOLATE ANY CONFIDENTIAL OR PRIVILEGED
RELATIONSHIP CONFERRED BY LAW.
(e) No report forwarded under the provisions of
this section shall be used as evidence in any civil or
criminal trial[.], EXCEPT IN LEGAL ACTIONS INVOLVING
ALLEGED VIOLATIONS OF CONFIDENTIAL OR PRIVILEGED
RELATIONSHIPS CONFERRED BY LAW.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1974.
