(f), 7-430(a), (e), 7-445, 7-456(a), (b), (d), (j),
7-457(f), 8-716(b), 8-1005(a), 9-301 (a), 10-101(y),
10-618(c), 10-705, 10-1005(b) of Article - Natural
Resources, of the Annotated Code of Maryland (1974
Volume) be and they are hereby repealed and re—enacted,
with amendments, to read as follows:

Article — Natural Resources
3-305.

(d) An electric company as defined in the Public
Service Commission Law may request from the Secretary an
appropriate site in his possession under the provisions
of this subtitle, and the Secretary shall make the site
available. The electric utility may purchase the site,
or lease it on a 99 year lease. The purchase price shall
be the fair market value of the site as determined by a
committee of three independent qualified real estate
appraisers, one of whom is chosen by the Secretary, one
by the electric company making the application, and the
third by the two appraisers first selected. Each party
compensates its own appraiser and bears one—half the cost
of the third appraiser. The leasing charge shall be
[five] 5 percent annually of the purchase price. For the
purposes of this subtitle, the leases are a proprietary
interest subjecting the electric utility to local
property taxes. Receipts from the purchase and leasing
transactions shall be deposited in the Fund. In view of
the safeguards provided by this subtitle through state
units, and to assure the controlling effect of their
determinations, any property an electric company
purchases or leases as provided in this subsection shall
be used and operated for electric generating and
associated transmission purposes without regard to any
local zoning rule, regulation, law, or ordinance, and
this use is not required to be submitted to or approved
by any county or municipal zoning board, authority, or
unit.

(c) A dip or landing net or seine not more than
[six] 6 feet in length nor more than four 4 feet in
depth may be used to catch bait fish.

4-621.

(b) A live bait dealer may sell only minnows, chubs
measuring less than [six] 6 inches in length, and
killifishes and mad toms procured from the waters of the
Potomac River. He may not possess more than 750 bait
fish of every type at one time. The bait boxes of the
live bait dealer shall be open for a Natural Resources
Police officer to inspect at any reasonable time.
