the public from unwholesome, adulterated, or misbranded
food or from fraud, in connection with transactions in

food; or

(ii) The applicant or recipient, or any person,
conducting a business with which the applicant or
recipient was responsibly connected, had inspection
services refused or withdrawn for a period which has not
expired; or

(2) The application for inspection contains a
materially false or misleading statement made by the
applicant or recipient, or its representative on its
behalf, or any fact required by the application form has
been concealed or withheld.

(b)   The tolerances for Grade AA, Grade A, and Grade
B eggs sold to consumers shall be as follows:

(1)    U.S. consumer Grade AA shall consist of shell
eggs which are 80 percent AA quality. Within the maximum
tolerance of 20 percent which may be below AA quality,
not more than [five] 5 percent may be B quality, C
quality or checks in any combination and not more than
0.5 percent leakers or dirties in any combination.

(2)   U.S. Consumer Grade A shall consist of shell
eggs which are 80 percent A quality or better. Within
the maximum tolerance of 20 percent which may be below A
quality, not more than [five] 5 percent may be C quality,
or checks in any combination, and not more than 0.5
percent leakers or dirties in any combination.

(3)  U.S. Consumer Grade B shall consist of shell
eggs which are 80 percent B quality or better. Within
the maximum tolerance 20 percent which may be below B
quality, not more than [ten] 10 percent may be checks,
and not more than 0.5 percent leakers or dirties in any
combination.

(c)   The annual registration fee for each commercial
feed distributed in the State is $20. Customor-formula
feeds and contract feeds are exempt if the registration
fee is paid on the commercial feeds which they contain.
In addition, any distributor shall pay an annual
registration fee of $25 for each brand of commercial feed
distributed in individual packages of [ten] 10 pounds or
less.
